This file was contributed for use in the USGenWeb Archives by: Jenny Penick Garner ==================================================================== Carroll County, TN Deeds Grantor: Sheriff Bk B, Pg. 184 Grantee: Edward Gwin [Index lists as E Gwin Jr. Date: 9 Mar 1829 Land: [First page missing] This indenture made this ninth day of March in the year of our lord One Thousand eight hundred and Twenty nine by and between Sion Rodgers Sheriff of the County of Carroll in the State of Tennessee of the one part and Edward Gwin of the County of Carroll and State of Tennessee of the other part witnesseth that whereas John Gwin lately before the Justices of the Court of pleas and quarter sessions of Carroll County holdin in the Town of Huntingdon in the said County of Carroll to wit at the December Term AD 1828 did recover by the Judgement of said Court against George S. Miller a certain debt of Eighty One dollars Twenty and One half Cents and also seven dollars Sixty seven and One half cents for his Costs and Charges by him about his suit in that behalf expended, which by the record whereof in the said Court remaining more fully appears and whereas the said John Gwin, prosecuted on the Judgement aforesaid Out of the Court aforesaid a certain writ of the state caled a Fine Facias Tested at the December Term AD 1828 of Said court to the Sheriff of Said county directed by Said court of pleas and quarter sessions by which Said writ was commanding the Said Sheriff that of the goods and Chattels lands and tenemenmts of the Said George S. Miller he Should cause to Be made the debt and cost aforesaid and that he should have those monies before the Justices aforesaid on a certain day now past to render to the Said John Gwin For his debt and cost aforesaid and also that writ and wheras the Said Sheriff By virtue of the writ aforesaid of Fine Facias to him directed as aforesaid Amongst other things did return that he has delived on the one third part of one acre of land on clear creek together with the mills and improvements Thereon in Said county of Carroll beginning on a small Iron wood with pointers on a Small island two and one fourth poles from the north east corner of a grist and Saw mill owned by John and Edward Gwin on clear creek thence running South Sixteen poles to a Stake on the west Side of the creek with maple and hickory pointers thence east (crossing the creek Ten poles to a Stake with black gum pointers thence north Sixteen poles to stake Thence west ten poles to the beginning as the property of the Said George S. Miller and that he had made there of Seventy five dollars of the debt and Cost aforesaid as by the Said writ and return (reference thereto being had more Fully and at large appears and whereas the Said Sion Rogers Sheriff as aforesaid in pur suance of Said writ of Fien Facias and according to the laws of the State in Such case Lately made and provided and the provisions and requisitions therein contained have ing Legally advertised and made known the Same did on the ninth day of March In the year of our lord one thousand eight hundred and twenty nine at the court House in the town of Huntingdon in the county of Carroll expose to sale by public Vendue or auction the aforesaid tract of land with the appurtenances to the same belonging and all the estate right Title claim and demand whatsoever of him the said George S. Miller in to and over the same, and whereas the said Edward Gwin did then and there bid for the same Seventy five dollars and no person bidding more the said Tract or parcel of land and premises with the appurtenances was in due manner openly struck off and sold to the said Edward Gwin for the said Sum of Seventy five dollars. Therefore to confirm the said purchase to the said Edward Gwin so as aforesaid made. This Indenture Witnesseth that the said Sion Rodgers Sheriff of the County of Carroll for and in Consideration of the sum of Seventy five dollars to him in hand paid by the said Edward Gwin the receipt whereof is hereby acknowledged, and by virtue of the laws of the state aforesaid, hath given, grnated, bargained, sold, released, conveyed, and confirmed, and by these presents doth give grant bargain sell release convey and confirm unto the said Edward Gwin, his heirs and assigns for ever all that said Tract or parcel of land bounded as follows, to wit, beginning on a small Iron wood with pointers On a small Island two and one fourth poles from the north west corner of a grist and saw mill owned by John and Edward Gwin on Clear Creek thence running South Sixteen poles to a Stake on the west side of the Creek with maple and hickory pointers thence East/crossing the Creek Ten poles to a Stake with black gum pointers thence North Sixteen poles to a Stake thence West Ten poles to the beginning with all the privileges and appurtenances to the same belonging or in any wise appertaining with all the estate, right, Title, Interest, property claims and demand of the said George S. Miller, in to and over, the same and every part and parcel thereof to have and to hold all and Singular the above granted & bargained premises and appurtenances to the Said Edward Gwin his heirs & assigns to the Only proper use benefit and behoof of the said Edward Gwin his heirs and assigns for ever, in as full and ample a manner as I the said Sion Rodgers by virtue of the Authority aforesaid might could or ought to Convey the same In Testimony whereof I have hereunto set my hand and Seal the day and year first above within. Signed Sealed and delivered in presence of (ack) Sion Rodgers Sheriff of Carroll County State of Tennessee Carroll County Court June Term 1829 The within deed of bargain and sale from Sion Rodgers Sheriff of Carroll County to Edward Gwin for the one third part of One Acre of land and the Third part of a grist and saw mill was this day produced in open Court and the execution thereof was duly Acknowledged by the said Sion Rodgers Sheriff as aforesaid to be his act and deed for the purposes therein Contained and Ordered to be Certified for Registration.
