All rights reserved. http://www.usgwarchives.net/copyright.htm This file was contributed for use in the USGenWeb Archives by: Jenny Penick Garner ================================================================================= Microfilm Roll 126 Grantor: Aser Wiley Vol G, Pg 194 Grantee: Edward Gwin Carroll County TN Deeds Date:31 Mar 1848 Gordon Browning Museum, McKenzie, TN Land: 73 Whereas on the 24th of July 1830 Samuel Ingram one of the acting Justices of the peace for said county rendered a Judgment against Aser Wiley for the sum of sixty five Dollars and interest from the first day of January 1830 with cost #c and also said Ingram one of the Justices as aforesaid on the 11th of January 1831 rendered another Judgement against said Aser Wiley for the sum of sixty Dollars and interest on the same from the 1st of January 1830 and cost and whereas on the 24th of January 1831 said Samuel Ingram then Justice as aforesaid issued an Execution on the aforesaid Judgement for sixty five Dollars besides interest and cost which on the same day came to the hands of James I. Britt a constable for the County aforesaid and the said Ingram as said Justice also on the day issued an execution on said Judgement for sixty Dollars besides cost and interest and the same on the 20th of January 1831 came to the hands of said James J. Britt constable as aforesaid and and said fifa to wit the one for 60 Dollars besides cost and and interest was on the 20th of January 1831 and the one for 65 dollars besides cost and interest was on the 24th of January 1831 levyed on the following named tract of land as the prop erty of Aser Wiley continuing by estimation 73 acres more or less Beginning on a post oak ? Stump NW corner Running thence west 102 poles to a stake thence North 15 west 114 poles to a post oak with pointers thence East 102 poles to a post oak with pointers thence south 114 poles to the beginning and whereas at the March Term of the Court of pleas and Quarter Sessions 1831 for the County aforesaid the said Justice Samuel Ingram returned into court the aforesaid two executives with the involvement aforesaid upon thence for the purpose of having said tract of Land condemed to be sold to pay the same and at said March term of said court 1831 Judgement was rendered against said land for the payment and satisfaction of said Execution and said tract of land by said court at said term whereas on the 13th of April 1831 orders of sale were issued on the aforesaid Judgements by the Clerk of said court directed to the sheriff of said County and the same came to the hands of James Latimer the then Sheriff of said County on the same day issued and after advertising and giving notice as the law directs He the said Sheriff by virtue of such orders of sale did sell said 73 acres of Land to Edward Gwin for the sum of twelve Dollars he being the highest bidder at public auction on the 13th of June 1831 Now therefore I Jeremiah T. Rust Sheriff of the County aforesaid and the successor of James Latimer for and in consideration of the aforesaid sum of twelve Dollars to the said Latimer in hand paid by said Edward Gwin and by virtue of the statutes in such case made and provided I do bargain assigns forever all the right title interest and claim that the said Acer Wiley had in and to the aforesaid seventy three acres of land by virtue of any office and by virtue of the above named proceedings to have and to hold for ever but no further or otherwise witness my hand & seal this the date above writen.
