Leach Decd: Contested Will This day came the parties by their Attorneys and thereupon the plantiffs produced in court the following notes of hand or paper writing with the several endorsements thereon which are in the words & figures following to wit $216.14 one day after date I promised to pay William Leach the sum of two hundred and sixteen Dollars & fourteen cents for value received. Witness my hand & seal January 19th 1850. Abner Leach (Seal) I assign Two hundred dollars of the within note to Martha Herron & the balance of said note Isabel Davidson January 25th 1853. William Leach his mark $46.20 one day after date I promised to pay William Leach the sum of forty six Dollars & twenty cents for value Recd January 19th 1851. Smith Leach (Seal) I assign the within note to Eliza Wilson. January 25th 1853 William Leach his mark $50.95 Due William Leach Fifty dollars & ninety five cents for value received Witness my hand & seal Decr the 18, 1852. Thos. R. Leach (Seal) I assign the within note to Eliza Wilson Jany 25th 1853 William Leach his mark On or before the first day of April 1850 I promise to pay William Leach the just sum of one hundred and forty nine dollars & sixty cents for value received. Witness my hand and seal Februay the 1st 1850 Abner Leach (Seal) I assign the within note to Jane Stewart January the 25th 1853. William Leach his mark $20.00 By the 25th of Dec next I promised to pay William Leach twenty dollars for value Recd Witness my hand and seal Nov 18th John D Leach (Seal) I assign the within not to Jane Stewart Jany the 25th 1853 William Leach his mark By the 25th of Decd 1853 I promised William Leach two hundred dollars for value recd. Nov the 18th 1851 Jas. Leach (Seal) I assign the within note to Margaret West January 25th 1853 William Leach his mark And the Plantiffs over that the endorsements on the foregoing notes or paper writings is the last will and testament of the said William Leach Decd. And thereupon the defendents comes and says that the same is not the last will and Testament of said Decd and for his trial puts himself upon the county & the plaintiffs doth the like. And thereupon comes a jury of good and lawfull men to wit David R. Green, Benjamin Gilbert Wilson Kelly Benard G Gordon Stanford Robinson James F. Simpson Thomas Stokes Samuel Ross Andrew Neely John R. Moore Samuel Hawkins and Cudy J. Smith who being elected and sworn well and truly to try the issue joined between the parties aforesaid upon their oaths do say that they find the issue in favour of the plaintiffs that said assignments or indorsements are the last will and Testament of the said William Leach Decd It is therefore considered by the court that the plaintiff recover of said Defendants the cost in this behalf expended as well below the court below as in this for which execution may issue and that the foregoing will be certified to the County Court of Carroll County for probate.
