Item 1st I desire first of all my Funeral expences be paid and all of my debts out of any moneys I may die possessed of or that may first come into the hands of my Executor after my death. Item 2nd. I give and bequeath to my beloved grand daughter Allice Mariah Elizabeth Spivy Daughter of my son Ruffin H. Spivy all of my Estate entire without reserve which is personal or perishable property. Item 3rd I desire that my Executor sell all of my perishable property as soon after my death as practicable consisting of stock provisions farming utensils househod and Kitchen furniture Except one Bed & furniture which I wish reserved for my grand daughter Allice M. E. Spivy. Item 4th I do appoint and make my friend Thomas S. Moore of the County of Carroll and state of Tennessee my Executor to this my last will and Testamentand I desire that he shall take my grand daughter Allice M. E. Spivy under his care and send her to school untill she shall have obtained thorough English education and the Expencis of the same be paid out of any property that I have bequeath to her in this my last will and testament I further desire that the property that I have given to my grand daughter Allice Mariah Elizabeth Spivy shall remain in the hands of Thomas S. Moore my Executor untill she shall marry or become of age. In testimony whereof I have hereunto set my hand to this my last will and Testament. This day a paper writing purporting to be the last will and Testament of John Spivy Decd was produced in open court and offered for probate The same being unaccepted to was duly proven by the oaths of A.
