Treadway and the daughter of Thomas D. DeLoach and Perlina M. Oliver. Her application to the Guion Miller Commission was the most detailed of those submitted by the DeLoach families living in Carter and Johnson Counties, and became the foundation upon which all of their applications were rejected by the Commission. Following this abstract of her application are several letters that were sent to members of Congress and the Commission by her attorneys. Dear Sir: We herewith enclose to you the applications of William DeLoach, George Canada DeLoach, Mary Jane Fair, Will DeLoach, James Scoon DeLoach and Samuel C. DeLoach, for participation in the fund of the Eastern Cherokee tribe of Indians, and trust that you will file same immediately, and if there should be error to kindly let us know. It was impossible for claimants to show the Indian names of their grandparents, except of one Stephen Wallen who was a Cherokee of the full blood. We telegraphed you to-day for 20 more blanks and trust that you can send them immediately. We are Attorneys of the State and Federal Courts of this State and have been sworn in as regularly practicing Attorneys of the United States Courts, but have not been in the practice of pension claims, and if necessary please enlist us, and if it is proper and necessary please send us the application blanks that may be necessary for us to sign. Madam: Kindly advise this office why your parents were not enrolled with the Eastern Cherokees in 1851. Did they ever live with the Cherokees as recognized members of the tribe? Did any of your immediate relatives ever share in a payment to the Eastern Cherokees? If so, give their names and state when and where they were paid. Were your parents held as slaves? Dear Sir: Your favor of May 20 instant just received, and in reply will say that so far as we have been able to ascertain, Stephen Wallen or Walden, as it was written both ways, was alive in 1848. He at that time somewhere between 65 and 70 years of age, and lived at some point in Powell's Valley, or near Wallen's Ridge, which was a portion of the original home of the Cherokee tribe of Indians. This tribe occupied portions of western North Carolina, North Georgia, and part of lower East Tennessee. Wallen or Walden, was a member of that tribe, but we have no evidence available at present of his having been enrolled, as late as 1851, and perhaps at that time he was not living. His daughter, Phoebe Walden or Wallen intermarried with John DeLoach, and moved to Sullivan County, Tennessee, where she lived for a number of years and then located in Carter County where she lived at the time of her death. It is understood that Stephen Wallen or Walden did live with and was recognized as a member of the Cherokee tribe of Indians. It is understood that the name Wallen or Walden was an english or adopted name, and that he had an Indian name, but it is not known what that was. We can establish conclusively by proof: (1) That Stephen Wallen who was a full blooded Indian did live with said tribe of Indians and that his daughter, Phoebe Wallen intermarried with John DeLoach. (2) Also prove the relationship of myself to Phoebe Wallen DeLoach. Further answering your letter, beg to say that Wallen nor any one under and through whom I claim never did receive or share in any payment to the Cherokee Indians. None of those under whom I claim were ever slaves. I would be glad to answer any further inquiry that you may make. Wallen nor any of those under whom I claim never did affiliate with or join other tribe of Indians or receive any sum or sums from the government.
