John Archer married Rebecca Smith in Washington County, TN in 1826. They moved to Sullivan County, TN then on to Carter County. This transaction was transcribed by Michael Stephen "Steve" Peters grandson of Johanna Archer. Johanna married George Frank Peters in 1885. This indenture made and entered into this 5th day of June A.D 1876 by and between John C. Smith Clerk & master of the chancery court at Elizabethton held for Carter County of the one part and the heirs of John Archer decd (to wit) BENJAMIN ARCHER, WILLIAM H. ARCHER, SARENA V. ARCHER, WILLIAM HICKS, REBECCA HICKS, REBECCA ARCHER, JOANNA ARCHER of the county of Carter of the second part witnesseth that whereas heretofore to wit. On the 13th day of February 1872 a decree was rendered in said court in the cause W.W. Rockhold et al against P Elliot and Archer & Haynes V, P.B. Elliot et al and recorded in Motion Book B. on page 282 which decree was based upon and by agreement of the parties and the following facts to wit. That on the 19th day of December 1857 P.B. Elliot sold to John Archer a tract of land of 175 acres for 750 dollars and paid down $500 and executed his note for the remainder of the &250 that said tract of land had been sold by order of this court for balance of purchase money and bid off by L.J. Elliot the legal title to said land being in the Bank of Tennessee it was by decree of the court at a former term divested out of the Bank and vested in said L.J. Elliot by agreement of the parties that is Elliot heirs who are of age & J.M. Pleasant against for said Archer heirs it was fully agreed in said decree that if the said Pleasant would pay the principal of said notes executed by John Archer to said P.B. Elliot that they would release all claim to the land and a lien was declared on the land for said amount due as purchase money and that C & M directed in said decree to make a deed to the said Archer heirs for said land when the balance of as agreed was fully paid and on the 2nd day of August 1872 a further decree was rendered in said court and entered in minutes book B page 326 reciting the fact that the purchase money declared at the Feb term on the land had been fully paid but that the money to pay the same had been furnished by Joseph Elliot and it was agreed and so decreed that said Elliot should have forty acres of said land and the Master directed to make him a deed for the same when furnished with causes. And the clerk & master was also directed to make the said Archers heirs a deed for the balance of said 175 acres tract of land upon being furnished with the boundaries thereof and paid the legal fee therof. Now therefore in consideration of the premises and by the virtue of authority vested in me by law and said agreed decree and in order to carry into effect the intention of the court do hereby transfer and convey unto the said BENJAMIN ARCHER, WILLIAM H. ARCHER, SARINA V. ARCHER, WILLIAM HICKS, REBECCA HICKS, REBECCA ARCHER, JOANNA ARCHER the following boundary of land being in the 12 Dist of Carter County to wit Beginning on a bunch of alders near Pleasant Spring Branch thence south 45 deg. East 50 poles with said Robinsons line to a state corner to J. Elliot thence north 70 deg. East with Elliot line 78 poles to a stake on Elliotts corner thence south 68 deg. East 60 poles to a black oak corner to Elliot thence north 11 poles to a small red oak the original Musgraves corner thence east with original Musgraves line 100 poles to a stake thence north with said line 100 poles to a white oak Henleys corner thence west 80 poles to a stake thence west 9 poles to Stover & Casses line thence south with their line 54 poles to a bending oak thence west 90 poles to a sugar tree corner to Stovers & Cass south 25 east 28 poles a birch corner to Stover and Cass thence south 40 deg. East 80 poles to the beginning containing 135 acres together with all and singular the hereditaments and appertenances to have and to hold to the said BENJAMIN ARCHER, WILLIAM H. ARCHER, SARENA V. ARCHER, WILLIAM HICKS, REBECCA HICKS, REBECCA ARCHER, JOANNAH ARCHER their heirs and assigns in fee simple forever and all do further hereby warrant and defend the title to the same unto the said parties as far as both by law and said decree of the court it is incumbent upon me to warrant and defend the same but no further nor otherwise.
