D. M. Showalter of Rockwood Tenn. and J. L. English of Rocky Mount Va. of the first part and Miligan College a body corporate under the laws of Tenn of the second part. Witnesseth: That whereas on the 27th day of Jan 1894 of even date herewith and contemporaneously with this instrument the trustees executed and delivered to the first parties hereof a deed in fee simple conveying the lands hereditument re mentioned and described therein in consideration that the first parties hereto assumed to pay to the Pioneer Savings and Loan of Minneapolis, Minn. the sum of ($3700.00) thirty seven hundred dollars and of this amount did pay to said Pioneer Savings and Loan Co. are that said Milligan College owes said Co. above $2700.00 and also a deed of trust on said Milligan College to secure the payment of said $2700 in one, two, and three years from date hereof. Now it is hereby mutually agreed between the first and second parties hereto that the first parties will pay to said Pioneer Savings and Loan Co. of Minneapolis or Minn. said $2700.00 and interest thereof when due; and that the second party hereto shall have until June 1st 1900 in which to redeem said Milligan College by paying to the first parties hereto said $2700 and 6% interest thereon (interest payable semiannually) and also by paying to the first parties together with 6% semi-annual interest the amount the first parties paid this day to the pioneer Savings and Loan Co. above the $2700.00 which said Milligan College owed said Co. on a mortgage. Which amounts together with incidental expenses including insurance on "Home" for a term of three years make up the items of $3700.00. It is further mutually agreed between the parties hereto that should the first parties fail or refuse to pay off said indebtedness due said Pioneer Savings and Loan Co. the second party may do so and shall have for such amount on its redemption from the first parties. The possession of Milligan College is subject to a private agreement between J. Hopwood leasor and C. D. M. Showalter. The parties of the second part further agree to pay back to the parties of the first part as a part of the redemption fund all insurance paid by the parties of the first part with lawful interest thereon (except insurance for a $2000 policy on "Ladie's Home" for three years from date and included in $3700 mentioned above.) and also the parties of the second part are freed from the payment of insurance for more than $5000 at a time on both the college building and "Ladie's Home." The second parties hereto agree to pay back with lawful interest to the first parties hereto all taxes and other money paid by the parties of the first part other than such amounts as are necessary to keep buildings in a good repair as they now are. Further it is mutually agreed that the parties of the first part shall receive their payments in sums of not less then ($500) five hundred dollars at a time unless it be last payment of redemtpion fund to them.
