Firstly, I give my soul to God to be dispossed of according to his good pleasure. Secondly, I require my executors here or after named to have my ___________in a chosen like manner. Thirdly, I require my executor to pay all my honest debt by and thorough the debt due _________ and should they be unable to raise the sufficient funds in the way they are hereby authorized to sell enough of my personal property not specifically bequeathed to ________ ______ _________. Fourthly, I give to my daughter Joanna Tipton, Manerva Boyd, and Adaline Bayless each fifty dollars to be for their sole use separate and apart from their husbands and there individual right shall be _________ __________ to my executors their fifty to each is to be paid in any good trade equal to their_________ __________ separately on two years after the death of myself and wife. Fifthly, I give and bequeath to my son Alphed T. Gourley one dollar to be in full of his part as share of my estate. Sixthly, I give and bequeath to my son Elkana D. Gourley one hundred dollars to be paid to him and the expirationof two years after the death of myself and wife. Seventhly, I give and bequeath to James dunbar, son of my daughter Eliza Dunbar a piece of land apart of the land I now live on supposed to be about twenty acres beginning on two Birches Corner to Michael Hyders son on the C______ch running then so as to included a spring on the branch and running a steep bank to the lower end of said bank then to the brand and deviou? the brand to a large rock in the turn of the branch then due north to the center of the cave that run by my house then along the road to about opposite the ________ of the near out field then along said line to the beginning. Provided herein should be daughter Eliza be now pregnant and have another child by said Dunbar that child shall be equal interest with the said James and provided further more that the said Eliza Dunbar shall have the use of the ______ and proffets of said land until said children come to be of age be hers for her sole use separate and apart from her husband should she marry again. Eighthly, I give and bequeath to my two daughter Catherine and Loretta one hundred dollars each to be paid them two years after the death of myself and wife to be paid in any good trade to be valued equal to iron at three cents per pound. Ninthly, I give and bequeath to my wife Mary Gourley during her life the tract of land on which I now live except so far as is her tofore given to the children or child of Eliza Dunbar conveyed to myself by Samuel Smallings the whole being about one hundred and fifty acres exception to the Dunbar children is taken out of David Gourley my son with the _____ _______ and app______there into belonging to remains his heirs and assigns for use and full simple providec___ hoever in consideration I require him to pay two hundred dollars of the trade bequeathed her tofore to said other children. Tenthly, I give and bequeath to my son Nathaniel Gourley the upper part of the Bailey tract of land supposed to be seventy acres agreeable to a conditional line to be made by William Boyd and myself which tract includes the house in which my son Alphed now lives. My son Nathaniel to have the use and occupation of the same after the years 1849 to be his, his heirs and assigns forever. Eleventhly, I give and bequeath to my wife Mary after my debts are paid for the use of herself and family all my land not especially bequeathed, also all my stock, kind, household and kitchen furniture____ and farming_______ and this grain and meat that may be on hand at my death to be disposed of by her as she may see proper and I give and bequeath to my said wife after the payments of my debts and ligation anything that may be ____ one from William Boyd in that I give _____ residence of my personal and real estate after the ligation and debts are satisfied. Lastly, I do hereby nominate and appoint my wife Mary Gourley and my son David Gourley executors and executrise of this my last will and testament and wish the courts not require security of them. Lusk Thomas Gourley Additional Comments: This is a copy of James Gourley will from Carter County, TN. I first got a copy from the county, but it was a very poor copy and was difficult to read. I was able to read more information from a microfilm and an excellent reader and just sit there and write it down as it came up. As you can see, there are still a lot of words that are blank as they could not be established. (I have never worked so hard to read a will before and I can see why names might have been missed before.
