TN Wills Vol. 2 Page 25 Monday, September Term 1858 Then was the Last Will and Testament exhibited and proven in open court of John Mothorn Decd. By James T. Carter and Peter W. Emmit the subscribing witnesses thereto which will is in words and [illegible], as follows. I, John Mothorn being of sound mind memory and discretion, but of feeling the infirmities of age gradually coming upon me and any Physical strength wasting and warned that the sands of life must in long run out, and according to the courses of nature I must be soon gathered to my Father, do make constitute and ordain this my Last Will and Testament First, I return my soul to God who gave it humbly and confidently, hoping and trusting in the atonement and a merciful providence for Salvation and immortality in the Kingdom of Heaven. My body I devise shall be returned to the dust from where it came with His resurrection upon my [illegible]. Then it be interred in a decent and Christian-like manner not with any pomp or show, but simple unsequestioned[?] style. The funeral expenses I devise shall be paid out of any assets belonging to my estate. Second. It is my will that any debts I owe be paid out of the assets belonging to my estate. Third. The worldly goods of which I am now seized and posssessed or hold together with the increase between this and the time of my death, I will and dispose of as follows. First. I desire and will that my wife Sally Mothorn have life estate in the farm upon which I now live, should she survive me. Said farm contains about one hundred and six acres and that she have the sole and exclusive contents and benefits after my decease. Should she survive me subject however to any wrong must? She might in her descretion see proper to make with any of her children, as to the cultivating or tending the same. After the death of my said wife I will and bequeath my said farm or tract of land to my two sons, George and William Mothorn, upon condition that they within three years after the death of myself and wife pay to my daughters Polly Heck, Elizabeth Morrell, Catharine Smith, Susan Vest, Christina Scott, Matilda Little, Sarah OBrien And Seney Hickey the sum of Fifty dollars each, to be paid in good trade at its cash valuation. In the division of said land between my sons George and William I desire that the portions of the farm upon which the Dowlery(?) herein stands and other buildings stands, shall fall to William but that an equal division of the farm as to value of it and appertenance to be made between. Secondly. I will and dispose of my personal property as follows: my household and kitchen furniture together with beds, bedding, other apparel, I bequeath to my wife during her natural life with the request that at her death they be equally divided among my Daughters above named. My Live Stock I desire shall be sold by my Executors and my debts of any I owe shall be paid out of the proceeds of sale and the balance be divided equally between my heirs. Thirdly. Should there be any personal property or real estate not herein provided for, belonging to my Estate I desire the same shall be taken possession of by Executors and sold and the proceeds of sale divided equally among my heirs. Fourthly. I do hereby appoint Henry Little and Reuben Hicks the Executor of this my Last Will and Testament, whereof I hereunto set my hand and affix my seal this 6 day of June A.D. 1857.
