All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/tn/tnfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jane Ann Jett Wheeler jettstream@comcast.net August 17, 2013, 8:44 pm Source: Carter County Probate Records 1796-1915 Written: October 16, 1869 WILL OF DANIEL SMITH I Daniel Smith of the County of Carter & State of Tennessee being of sound mind & memory do on this 16th day of Oct in the year of our lord one thousand Eight hundred and sixty nine publish this as my last will & Testament hereby Revoking all other wills or parts of wills heretofore at any time by me made (to wit) first—I desire that that [sic] my funeral Expenses & all my just debts be paid as soon after my death as possible out of any moneys I may die in possession of that may come into the hands of my Executors Thirdly [sic] all my lands consisting of two several farms the one known as [F]ish [S]prings farm & the other as the home farm on which I now live and have conveyed to my four sons Ezl. Edward I John H. & Lawson W. Smith that is to say my home farm to Edward I & Lawson W. Smith by deed Executed on the 13th day of March 1858 and my [F]ish [S]pring farm to my sons Ezl. & John H. Smith to Ezl. by deed dated the 15th day March 1858 and to John H. Smith by deed dated on the 5th day of March 1859 as shown by the several deeds herein referred to Fourthly I give and bequeath to my oldest daughter Celia Hampton's four children (to wit) Mary Francis Jane & Matilda children of my daughter Celia Hampton Dec'd twenty dollars Each to be paid by my Executor within one year after my death Fifthly my granddaughter Mary Elizabeth Campbell twenty dollars to be paid by my Executor Sixthly to my daughter Matilda Dyer I have already provided for in the conveyance of land in Doe River cove where Elijah Simmerly now lives Seventhly I give and bequeath to my daughter Mary E. Smith wife of James D. Smith three hundred dollars to be paid by my Executor as soon after my death as possible Eightly I give and bequeath to my daughter Hiley J. Smith four hundred dollars which amount if not sooner paid I desire my Executor to be paid over as soon as possible Ninthly I give & bequeath to my son Lawson W. Smith of my personal property two milk cows & their increase four head of young cattle my Black Smith tools allso my still & side board one cupboard three beds including the one he lodges in & one half of the cooking utencils & kitchen furniture & five sheep & my waggon Tenthly—to my daughter Hiley J. Smith one Cupboard and Bureau two milk Cows & Calf five sheep two beds & furniture the balance of my personal property to be sold & and all my debts to be Collected lastly I hereby appoint my son Ezl. Smith & Smith Campbell my Executors of this my last will & testament in witness whereof I have set my hand & seal the day & year above written.
