Maxwell ¦ Be it remembered that this cause came on to be heard this 1st day of October 1855 before the County Court of Coffee County upon the petition of the parties and proof heard before the Court when it appeared to the Court 1st that the widow Rebecca as the widow of said Jeremiah Jacobs was entitled to dower in the lands in the pleadings mentioned and that the same has not been assigned her. It is therefore now decreed by the Court that (Elzy Kuling?), County Surveyor, James Gibson and John H. Lawrence be and they are hereby appointed to assign said widow dower in said lands according to law and it appearing to the Court that the balance of said lands are so situated that they cannot be partitioned between said parties and that is manifestly their interest that the same should be sold but in as much as it does not appear to this Court what said lands are worth per acre and in as much as this Court (be ascertained?) until after the dower is assigned to said widow. It is ordered that the Clerk of this Court hear proof upon this subject and report to the next Term of this court. It also appears to the Court that said parties are entitled to have the slaves in the pleadings in this cause mentioned partitioned. It is therefore now decreed and ordered that John Lawrence, James Gibson, James Lawrence, B. F. Moore, and W. B. Watterson be and they are hereby appointed commissioners who are hereby directed to proceed to partition the slaves in the pleadings mentioned in this case among said widow & heirs assigning them to said parties share and share alike as near as may be and that they report to the next Term of this court until which the coming in of said Report all other matters are reserved.
