Rollins SRol786334@aol.com ==================================================================== Note of indebtedness: Kencheon Matthews, Nancy Matthews, Alexander Powell This indent???? made this 8th day of March in the year of our Lord one thousand eight hundred and thirty seven by and between Kincheon Matthews of the county of Coffee and State of Tennessee of the first part and Alexander Powell of the second part, whereas the said Kincheon Matthews is indebted to one Nancy Matthews in the sum of three hundred dollars by one note of hand dated the 25th of December 1836. and due one day after date last past and who said Nancy Matthews being willing to wait Twelve months longer with the said Kincheon Matthews upon her debt and interest being secured and the said Kincheon Matthews being willing to give her a certain assurance that her money shall be paid at the expiration or twelve months from the date thereof. This indenture witnesses? that the said Kincheon Matthews as well in consideration of securing the said Nancy Matthews in who faithful payment of the debt and interest aforesaid as also the sum of one dollar to him the said Kincheon Matthews in hand paid by the said Alexander Powell the Receipt whereof is hereby acknowledged ????? granted bargained and sold, transfered and assigned and set over and by this presents do unto grant sell over transfer and set over unto the said Alexander Powell his heirs and assigns one negro named Robert aged about nine years also one boy by the name of Jefferson aged about eight years slaves for life, to have and to hold the two negro boys and each and every of them unto the said Alexander Powell his heirs and assigns to the proper use and behoof of the said Alexander Powell his heirs and assigns forever in trust however to the intent and purpose that if the said Note for the sum of three hundred dollars and all lawful interest thereon are not well and freely paid off and discharged before the expiration of Twelve months from the date by the said Kincheon Matthews or some other person for him then and in that case the said Alexander Powell has in the execution of the Trust hereby taken upon himself to advertise the said property to wit, the said above named Two Negroe boys by written advertisement at four of the most public places in said county one of which shall be at the court house door of the County aforesaid that this will expose to the highest bidder the said Two Negro boys and after said sale to make good and sufficient bills of sale to properly convey all the right title and interest that the said Kincheon Matthews or his heirs may have to said two Negro boys provided never the less that if the said money and interest should be paid before the day of sale herein authorized then this indenture to be wholly void and of no effect either in law or equity in writing thereof the said Kincheon Matthews hereunto sets his hand and seal the day above written.
