Rollins SRol786334@aol.com ==================================================================== Deed: Charles Coulson to Alexander Powell This indenture made this twenty fourth day of April one thousand eight hundred and thirty seven between Charles Coulson of the County of Warren and State of Tennessee of the one part and Alexander Powell of the County of Coffee and state aforesaid of the other part Witnesseth: that whereas Moses Matthews late of the County of Coffee executed a deed in trust to the said Charles Coulson to secure the payment of the sum of eight hundred and sixty seven dollars and four cents with lawful interest thereon to be paid four months from the date thereof and if the said sum of money with interest should not be paid before the expiration of Four months as aforesaid then the said Charles Coulson was to advertise in the Central Gazette a newspaper printed in McMinnville and at the Courthouse door and four public places in the County of Coffee and if at the time of the sale the money still remained unpaid or any part thereof then the said Charles Coulson was to proceed to sell said lands according to the stipulations of said deed of trust which will more fully appear by reference to the same - and which said tracts containing three hundred and twenty acres, being the same tract of land conveyed to David Bird by James Sheppard by deed bearing date the 28th February 1817 and bounded as follows, Beginning at a stake the West boundry line of a five thousand acre tract of land granted to David Ross and by him conveyed to said Sheppard thence East 320 poles to a stake in a timbered flat ridge, thence North 160 poles to a stake thence West 320 poles to a stake in the aforesaid West boundary line of the said five thousand acre tract, thence South with said line to the beginning with it appertainances - also one other tract of land in the County of Coffee Tennessee, containing sixty acres to the same more or less being the same tract of land conveyed to David Bird by the aforesaid Jas Sheppard by deed bearing the date the first day of August 1823 and bounded as follows (to wit, Beginning at a stake the Southwest corner of a 320 acre tract of land deeded from Sheppard to Bird running East with the South boundary line of said 320 acre tract to the main road leading from where A.? G. Hunt formerly kept a store to Dials Mills thence southwardly and with the west boundary line of this tract of land when Langston and John Cunningham now live to the north East corner of a tract of land Enoch Dials line on thence with his north boundary line to the northwest corner of Dials one hundred acre tract thence North to the beginning with its appertainances. And whereas the said Moses Matthews wholy failed to perform and coply with the terms of said deed of trust, by paying the money aforesaid within the time aforesaid , And whereas on the fourth day of March 1837 the said Charles Coulson trustee as aforesaid proceeded to sell the aforesaid described tracts of land having first advertised the same according to the stipulations in said deed of trust mentioned for ready money, at the court house door in the town of Manchester in the County of Coffee aforesaid and did sell the same to Alexander Powell for the sum of eleven hundred and forty two dollars, he being the highest and best bidder. Now this indenture witnesseth, that I Charles Coulson by virtue of power and authority in me vested by said deed of trust and the statutes usages and customs in such cases made and provided hath bargained, sold, aliened in?????????? and conveyed and by these presents doth bargain sell alien ????????? and convey unto the said Alexander Powell his heirs and assigns for the consideration of eleven hundred and forty two dollars to me in hand paid by him the said Alexander Powell the receipt whereof is hereby acknowledged - To have and to hold to the said Alexander Powell the aforesaid tracts of land with all and singular the here??? ments and appurtainances thereto belonging to him his heirs and assigns forever - And the said Charles Coulson doth covenant and agree to and with the said Alexander Powell, that he will forever warrant and defnd the right and title of said land to him the said Alexander Powell his heirs and assigns forever free from the lawful claims or demand of him the said Moses Matthews his hand or any other person claiming by? through or under him or them, In wintess whereof I have herein set my hand and seal this day and date above written.
