Carter - Will - Probated September Tern 1892 Minute Book E page __ Know all men by these presents that I SARAH O. CARTER of the County of Crockett and State of Tennessee, being of sound mind and in good health do make and constitute this as my last will and Testament. 1st: I ask that I shall have a decent burial and as soon after my decease as praticable that all of my Just debts shall be paid by my Executor Hereinafter appointed by me. Second: I will and bequeath that my real estate which consists of my home tract of land of 70 acres Bounded as follows on the north by the land of J. W. WATSON on the East by the lands of W. C. TYREE on the south by the lands of J. C. DUNGAN on the west by ROPER HEINS. That the same shall be Equally divided between my two youngest children namely W. T. TAYLOR and S. E. SMITH wife of L. S. SMITH For the love and esteem I have for them they having lived with me and helped me to pay all of the debts against said premises. Third: I will and bequeath that all of my personal property shall be Equally divided between them the said W. T. TAYLOR and S. E. SMITH. Fourth: I hereby constitute and appoint J. M. COCHRAN as my Executor to Execute this my last will and Testament, hereby making void all other wills by me at any time made. (X) HARBER ==================================================================== William Carter - Will Probated November Term 1894 Minute Book E page 711 I WILLIAM CARTER of the County of Crockett State of Tennessee. Knowing that in the course of nature I can not live long and being desirious of disposing of the property with which by the favor of God I am in possession of in such a manner and way as in my judgment will be best. I do hereby make ordain and publish this my last will and Testament in the following words; First I will and direct that all my just debts arising from sickness funeral burial or otherwise be paid out of the first money that comes into the hands of my Executor. Second I leave to my beloved wife LUCINDA during her natural life or widowhood all of my Estate both personal and real to use for her and my childrens support and maintenance. Third I further more will that when my wife Shall cease to be my widow either by marriage or death that my Estate both personal and real be equally divided among my children each to share, and share alike, except my three minors, WILLIAM H., THOMAS and FRANK, which I wish to have one Hundred and fifty dollars to raise them on to be paratered (?) according to their ages, and the oldest less than the second and the second less than the youngest, so they may be made equal. I further direct that my Son WILLIAM H. on account of his afflictions have one Hundred dollars more than my other children. Fourth I direct at my death that my Executor sell privately for cash or on time any stock or other personal property that my wife may not wish to keep after paying all expences and debts if any to pay the remainder to my wife. Fifth I hereby nominate and appoint my wife LUCINDA CARTER as my Executor of this my last will and Testament and revoke all other and former wills made and executed by me. Carter - Will - Probated at Jan. Term. 1903 M. B. 8 Pg. 274 I, J. M. CARTER of the County of Crockett and State of Tennessee: Being of sound and disposing mind and memory do make this my last Will and Testament in manner following, that is to say: - First - I direct that my executor herein after named to pay out of my estate as soon as possible after my death all my Just debts together with the expenses of my last sickness and funeral and testamentary expences. Second: - I give and bequeath to my wife EUGENIA CARTER my home place where I am now living containing about Eighty two acres also, the stock I have in Bank together with all notes and money on hand: all my household and kitchen furniture all my horses and cows, farming implements and all feeds that may be in my barns at the time of my death: Third: - I give and devise unto my son CARY CARTER one half of a tract or parcle of land known as a part of the Stith farm and this is to be the division, he is to have all South of the public road being about Forty acres: and eighty five acres on the West side of said tract running from the public road to Black creek, making in all about one Hundred and twenty five acres to have and to hold to him as he directs and assignes forever. Fourth: - I give and devise unto my son ROBERT H. CARTER the one half interest of the aforesaid tract of land: he is to have the East side running from the public road to Black creek to have and to hold to him as he directs and assignes forever: Fifth: I appoint EUGENE CARTER my wife to be the sole Executor of this my will without bond or affidavit: Sixth: Whereas I have left certain property to CARY and HARRY CARTER both of whom being minors I do hereby appoint EUGENIA CARTER my wife as guardian without affidavit or bond for them if they be minors at the time this shall take affect, giving to her the right of control over the person and property of said minors until they severally reach the age of Twenty one years of age. EARLEY ==================================================================== Will of AMANDAY CARTER Probated April the 16th 1906 Know all men by these presents that I AMANDA CARTER of Crockett County Tenn. for the love and affection I have for my son CLABE POWELL and he having lived and taken care of me for a good many years, I do sell and give to him my farm situated and lying in the 10th Civil District of said County, butted and bounded as follows to Wit: on South by HENRY JONES, West by BOOTHE, North by MRS. JENNIE CARTER and on East by Public Road containing 48 acres more or less. To have and to hold this farm to the said CLABE POWELL, his heirs and assigns forever; but CLABE POWELL is to take care of his sister LAURA POWELL and she to live with him. I also will and bequest that all the personal property consisting of one horse "Named Frank" this is LAURA'S, I give Buggy, waggon, household and kitchen furniture also to CLABE POWELL my son, as above agreed to take care of LAURA POWELL. I hereby appoint my son my legal representative and authorize him for me, to give my son GEO. POWELL one dollar in cash, and my son FOUNT POWELL one dollar in case & SILLA CARPENTER my daughter one dollar in cash and my daughter LAURA POWELL one dollar in cash. This is my last Will and Testamony, all others that have been made heretofore is hereby revoked, also I give LAURA POWELL one cow and one heifer. CARTER of Maury City Tennessee being of sound mind and disposing memory make this my last will and testament - revoking all others hertofore made by me if any. First: I direct that as soon after my death as practicable my Executrix whom I will nominate herinafter , pay off all Debts and obligations resting uppon my estate including funeral expenses. Second: My beloved wife MRS. LORINA CARTER having a competancey of her own I give and bequeath to our beloved son THOMAS FRANKLIN CARTER all of my property of Every description Lands moneys notes accounts and all property in which I have and interest Stocks bonds etc. Third: I hereby nominate my beloved wife MRS. M. LORINA CARTER as Executrix to execute this my last will and having full and absolute confidence in her integrity and fidelity I beg the court to excuse her from giving bond or taking the oath as such. Fourth: I beg the court also to appoint the said MRS. M. LORINA CARTER Testimentory Gardian for our said THOMAS FRANKLIN CARTER he being at this time a minor under twelve years of age and I epressly ask also the she be excused from bond or oath as such. Fifth: I expressly empower my said Executrix to sell any or all of my property real or personal at any time she sees proper and make title to the purchaser. CARTER of Maury City Tennessee, being sound in mind and of disposing memory do hereby make this my last will and testament revoking all other wills if any heretofore made by me. First: I direct that my executor whom I shall hereafter nominate pay off and fully discharge all debts and obligations as soon after my decease as practicable. Secondly. I give and bequeath to my wife MRS. NANCY A. CARTER one fourth of all my estate both real and personal with the priviledge and powers of using and holding the same during her natural life having in mind that she should be AMPLY provided for in her old age. Thirdly. I give and bequeath to my three children as follows, MRS. WILLIE A. HARDISON, one fourth of my net estate. J. T. CARTER One fourth of my estate. MRS. IREEN M. HELLEN, one fourth of my net estate, all subject to the second item the bequest of my wife. Fourthly. I direct and empower my executor to sell and make title to any or all of the real estate I may die possessed of. I also empower him to sell or dispose of any or all perishable property, and to use his own discresion as to the best way and manner to manage this estate. Fifthly. I hereby nominate my son, J. T. CARTER as the executor or this my last will and testament and having full faith and confidence in his honesty, integrity, and faithfulness ask the court to excuse him from taking the oath or executing bond as is usual in such cases.
