POWELL - Will probated April Term 1893 Minute Book F. page 55 Know all men by these presents that I, WM. H. POWELL of the county of Crockett and state of Tennessee...do hereby make this as my last will and testament... Mentions: To my beloved wife SARAH A. POWELL, tract of land of 54 acres... with all improvements... in the 6th civil District of Crockett County... bounded on the north by JOHNSON, south by COBURN, west by THOMPSON and east by BOLING... also all furniture... except a bed and its fixtures for each one of my boys by her... various livestock... buggy & harness... and farming impliments that I may have on hand and 1/2 of the 207 acres tract during her life; To my Grand daughters (children of my deceased son JOSEPH) DOLA McNAT and MOLLIE MOORE the 100 acre tract of land whereon their mother now lives, bounded on north by J. F. ROBERTSON, south by BELL, west by MRS. ROOKS and east by ROBERTSON or NANCE. To my son E. JEROME POWELL one half of 223 3/4 acre tract of land situated in Dyer County on which he now [lives], bounded on east by J. C. MURRY heirs and DANIEL E. PARKER, south by G. W. WALKER, J. R. POWELL the other one half of the above described tract. To my son JOHN L. POWELL the farm I formerly occupied of 207 acres situated in the 11 civil District of Crockett County, bounded on the north by LEGGETT, south by DARDEN, west by J. H. PERRY & NANCE and east by NANCE & SWIFT Col... also horse bridle and saddle. To my son EDDIE H. POWELL the 150 acres tract of land in the 10th civil District of Crockett County, bounded on the north by the POSTON land, south by JENNINGS, west by DR. FLEMING land and east by JENNINGS. Minute book "9" page __ I, MOLLIE J. POWELL, do make and publish this my last will and testament, hereby revoking all former wills by me at any time made. First Item: I give, devise and bequeath to my husband DAVID HENRY POWELL, my farm for and during his life, Said farm lies in the 11th civil district of Crockett county, and is the same upon which we now live, and contains about 43 acres. Second Item: at the death of my said husband DAVID HENRY POWELL, said tract of land is to go to my three sons, CLAUDE L. POWELL, DAVID HENRY POWELL and ATHEL L. POWELL; provided however that they take said land charged with the following bequests. Third Item: I give and bequeath to my four grand childred, JAMES DAVID, JOSEPH W., JOHN E. and ANNIE, childred of J. B. POWELL deceased the sum of Fifty Dollars each to be paid to them as they reach their majority. Fourth Item: I give and bequeath to my son CLAUDE L. POWELL, the sum of two hundred and seventy eight Dollars ($278.00). Fifth Item: The two hundred Dollars bequeathed to my grand children under 3rd item is to be paid equally by my three sons, CLAUDE, DAVID and ATHEL, and the same is to be charged on their respective interest in said land. Sixth Item: The bequest of two hundred and seventy eight Dollars $278.00 to my son CLAUDE under 4th item, is to be paid to him by my other two sons DAVID and ATHEL and the same is to be a charge on their respective interests in said land. Seventh Item: Should either of my sons die without issue before coming into the possession of said land, his interest in said land shall go to the survivors. And should either of my grand childred die without issue before said legacy is paid to them his or her part of said legacy is to go to the survivors. Eighth Item: In the event either of my sons should fail or refuse to pay his prorata of the amount necessary to pay the bequests set out under the 3rd and 4th Item the interest of such delinquent in said land shall be sold by the executor to satisfy said legacy. Ninth Item: I nominate and appoint my son CLAUDE L. POWELL as the executor of this my last will and testament and request that he be excused from making bond as such, as I have the utmost confidence in his integrity. POWELL - Probated Sept. 27, 1932 I, DR. J. L. POWELL of Friendship, Crockett County, Tennessee, do make and publish this as my last will and testament... Mentions: To my wife EDNA B. POWELL only for and during her natural life my farm in the 11th civil district Crockett Co., TN, and consisting of 140 acres and bounded on the North by the G. M. and N. R.R., on the South by the lands of TUCKER estate, East by the lands of J. C. HAMLETT, on the west by the lands of BOLING, TUCKER and E. H. POWELL, and at the death of my wife I hereby will to my youngest son, JOHN POWELL JR. fifty acres of the said farm for his natural life and then to his bodily heirs, if any, and if he should die without issue I will that the said fifty acres revert to his brothers or the survivor of LELAND POWELL and ROSWELL POWELL and in the event of the death of LELAND POWELL and ROSWELL POWELL at the death of JOHN POWELL, JR. and neither have bodily heirs the said fifty acres revert to the nearest kin... I direct that my residence and home place in the 12th civil district of Crockett County, TN, and in Friendship, be sold within two years from my death or sooner... property is the acreage across Highway No. 20... and the proceeds divided between my wife and sons, ROSWELL POWELL, LELAND POWELL, AND JOHN POWELL, JR. I direct that all my just debts debts shall be paid as soon after my death as possible; and if the debts due me, and the proceeds of the sale of my perishable property be insufficient for that purpose, my Executors, hereinafter named, are authorized to sell so much of my other estate, real and personal, as may be necessary to pay such debts. II. I give, devise, and bequeath, in equal parts, to my brothers, A. L. POWELL and D. H. POWELL, all my estate of every kind and character, both real and personal, wherever the same shall be located, as their absolute property to the exclusion of all other persons; provided that if only one of my said brothers shall survive me, then all of my estate of every kind and character, both real and personal, wherever located, I give, devise, and bequeath to such brother, as his absolute property to the exclusion of all other persons. III. I hereby nominate and appoint my said brothers, A. L. POWELL and D. H. POWELL, as join Executors of this my last will and testament, with full power and authority to execute the same according to its true and intended meaning, and having perfect confidence in their judgment and integrity, I direct that the said Executors shall not give any security or bond; provided that if only one of my said brothers shall survive me, then I nominate and appoint such brother as the Executor of this my last will and testament, and direct that he not be required to give any security or bond.
