Slade, 18 Sep 1871 ----¤¤¤---- State of Tennessee, Davidson County Monday morning Sept. 18th 1871, County Court William H. Slade vs. } Petition Thos. D. Price et als To the Honl. W.A. Glenn Judge of the County Court of Davidson County!! The Petition of William H. Slade a citizen of the County of Davidson, Tennessee! VS Thomas D. Price and his wife Fanny Price, Sarah E. Slade, citizens of Smith County Tenn. and her Guardian James M. Miller, & Mollie Slade citizens of Davidson County Tenn and her Guardian F. O. Hurt who is now a non-resident of this State. Shows your Hon. that on the day of October 1864 Nathaniel J. Slade departed this life in said Davidson County siezed and possesed the following real estate, situate in the City of Nashville in said County, and ? of one Lot of fifty feet front on the West side of Wharf Avenue between Jefferson and Washington Streets, also 104 feet front on the North side of Fillmore St. a more minute description the petitioner cannot now give. There is a double tenement house on the Avenue Lot and there are ? houses on the Fillmore St. Lot one of which was the homestead of the family at the date of said N.J. Slade's death. The defendant Fannie Price is the widow of said deceased and since his death she has intermarried with the defendant Thos. D. Price who is her present husband and she is -? --- to dower in said land and has never been assigned her. The petitioner and the defendants Sarah & Mollie are the only children and heirs at law of the said N.J. Slade and are the owners of said land subject to the dower interest of the said Fannie. The petitioner and defendant Mollie are the children of the said N.J. Slade by his first wife who died. After her death he married the defendant Fannie and had by her the defendant Sarah E. and then he died intestate. The parties here to acquire title to said land by inheritance from their said deceased father and husband N.J. Slade who owned the land by absolute fee simple title. The defendants Sarah & Mollie are minors and their Guardians are named in the ? . The defendant F.O. Hurt was the Guardian of plantiff for many years and as such the petitioner prays that he be held to account to the Court. The ? considered petitioner prays that the parties named as defendants be made such by proper process of ? copy bill & publication, that they be required to appear and answer this petition, that said dower be set apart to said widow, that the land be partitioned, if practicable between the parties, according to their respective rights. If not susceptible of parties, that it be sold and the proceeds be partitioned, that a survey be ordered to ascertain the exact locality and boundary of said lots, that Guardians ad litens for said minors be appointed if necessary, that commissioners be appointed to allot said dower and to partition said land or lots. On final hearing will your Honor ? the account of said F.O. Hurt as Guardian of your petitioner and said Mollie and require him to show fully what money or other effects of said wards he has received and what disposition he has made of it and grant such other, further general and special relief as may seem meet in the premises. Slade a minor orphan came into open court and renewed his bond as such in the sum of Three thousand Dollars with T. J. Yarborough and T. H.
