Sessions 1833. No. 120. Joseph C. Thompson by (?) Plaintiff Willis Cannon and wife and others defendants….Contested Will. This day came the parties by their attorneys and there upon came a Jury (etc.?) to wit: James CLEMMONS, Henry COMPTON, Valuntine (?) WINFREY, Jefferson PAGE, Matthew C. QUINN, James LONG, Freeman FRY, James GRAY, Jesse I. or L. EVERETT, James T. (?) LOVE, Thomas BYROR (?) and Stephen BRADLEY, who being elected tried and sworn the truth to speak upon the issue joined and say whether or not a paper writing here exhibited in Court bearing date the 31st day of January 1826 witnessed by Jason H. Thompson, John Mc. Thompson and Jeptha Mosely purporting to be the last will and testament of Jason Thompson Dec'd is such will of said Jason. And the jury having heard the evidence of Jeptha Moseley, John Thompson, Felix GRUNDY, Nathaniel A. McNairy and other witnesses upon their oaths do say that the said paper writing is the last will and testament of the said Jason dec'd. It is therefore considered by the court that the Plantiff do recover against the said defendants the costs of this suit expenses etc. and that execution issue. And it is further considered that the said paper writing be admitted to record as the last will and testament of said Jason Thompson dec'd. Whereupon John McNairy, Nathaniel A. McNairy, Mrs. Thompson and John Mc. Thompson executors named in said will in open Court here renounce their right of acting as such. And Mrs. Thompson widow and relict of said Jason in open court here here descents (dissents) from the provision of said will respecting her and claims her legal dower and distributive share. Test.
