Witnesseth that the said Robert Hays for and in consideration of the sum of two hundred and fifty dollars to him in hand paid before the signing & sealing of these presents hath sold, bargained & granted unto the sd. James Gatlin four hundred and twenty acres of land on the head waters of Whites Creek the survey calling for six hundred and forty acres, a part of which the sd. Hays has this day deed away to Thomas Smith to the amount of one hundred and twenty acres as will appear by deed to sd. Smith and the sd. Gatlin is to have the remainder of the sd. six hundred and forty acres. No. of the Grant 2487. Beginning at a birch & sweet maple thence East three hundred and twenty poles to an Oak thence North three hundred and twenty poles to a Birch then West three hundred and twenty poles to a Birch: then South three hundred and twenty poles to the beginning be the same more or less the one hundred and twenty acres deed to Thomas Smith as will appear by deed excepted & not to be deemed to be deeded to James Gatlin. To have and to hold the sd. bargained premises with all singular appertunances thereunto belonging to the only use and behalf of him the sd. James Gatling his heirs & assigns forever - and the sd. Robert Hays doth warrant & forever defend the sd. five hundred and twenty acres of land and bargained premises against himself and his heirs or any other person claiming lawfully by or through them either in law or equity and not otherwise.
