In District No.2 and bound as follows: Beginning in the centre of Mill Creek at the north corner of the tract of land formerly purchased from Isaac PAUL by Henry HILL thence Northwardly up the centre of said creek 73_16 poles thence Easterly at 40-1/2 [degrees – my keypad has no such symbol] E. 3 poles thence South 57 [degrees] 21.09 poles to John BOSLEY’s line _ thence N 40-1/2 E 10 poles to a stake thence ¼ E 12-7/100 poles to SMITH’s line thence South 9-3/4 [degrees] W along SMITH’s line 112 6/100 poles to the beginning containing by estimation thirteen acres and one hundred and twenty poles, and being the same conveyed to Mrs. Nancy AKIN by Joseph BOOTH a free man of color by deed duly recorded in the Registers Office of the county aforesaid in Book No. 32 page 2118 and is which reference is hereby made. To have and to hold to the said James O’BRIEN his heirs and assigns forever. and we covenant and agree to and with the said James O’BRIEN that we are lawfully seized and possessed of said land, have a good right to convey it, and that the same is unencumbered. We do for this covenant and agree and bind ourselves, our heirs and representatives to warrant and forever defend the title to the said lands to the said James O’BRIEN his heirs and assigns against the lawful claims of all persons whatever. Jack, Com Clerk of the County Court of Jefferson County in the state aforesaid do hereby certify that on this day the foregoing deed was produced to me in my office and acknowledged and delivered by Milton AKIN a party thereto to the his act and deed all of which is hereby certified at the proper office for records for testimony whereof I have set my hand and official seal this 19th day of July 1867. Johnson, May 17, 2004 Obtained from Metropolitan Nashville Davidson County Archives, May 17, 2004 Microfilm Roll No. 25, Vol. 38 & 39, 1867-1869 (hard copy in my files) Grantor: Milton AIKEN, etal Grantee: James O’BRIEN Date of Instrument: July 19, 1867 Date Filed: Jul 29, 1867 Land, 2nd District Deed Book 38, page 276 (Source of above information: Direct Index to Warranty Deeds, Etc. – Davidson County, Tenn., a microfilm viewed by Jeanne Johnson at Metropolitan Nashville Davidson County Archives, Nashville, TN, Nov. 2004) RESEARCH NOTES: Registered September 28, 1861, a deed in which Joseph BOOTH, a free man of color, conveyed to Nancy AKIN a piece of land beginning in the centre of Mill Creek near John BOSLEY’s line. This is the identical piece of real estate transcribed here when her son Milton and her daughter Matilda AKIN RYMAN sold it. Nancy died January 19, 1864. Her husband Moses died June 4, 1850 so Nancy purchased this real estate after his death. We have four children for Moses and Nancy but only data on Milton and Matilda. It is doubtful that the other two survived childhood. The deed index has Milton’s surname as AIKEN but the deed actually states AKIN.
