In the name of God, Amen. I Samuel Bell Senior of the county of Davidson and State of Tennessee being in sound mind and perfect memory thanks be given unto God and calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give and bequeath my soul into the Hands of Almighty God that gave it and my body I recommend to the earth to be buried in a decent Christian like manner at the discretion of my executors nothing doubting but at the General resurrection I shall receive the same again by the mighty power of God and as touching such worldly state where with it has pleased God to bless me with in this life. I give and demise and dispose of in the following manner. To wit that is to say first of all I give and bequeath to my Beloved wife Jane Bell free and peaceable possession of my now dwelling house and kitchen and so much of the kitchen furniture and two feather beds as may be absolutely necessary for her accommodation with one good horse saddle and bridle to be worth eighty dollars during her natural life the furniture also named to be at her own disposal at her death. Except the houses which will be disposed of hereafter also allowing my wife Jane the benefit of one negro girl by the name of Patsey during her lifetime then to be disposed of as will hereafter appear. 2ndly. I give and bequeath to my son John Bell the land I have deeded to him on the waters of Harpeth it being as I think his equal share 3dly I give and bequeath to Samuel Scott my so-in-law whose wife is dead the sum of five dollars besides what I have already given him. 4th I also give and bequeath to my beloved daughter Jane Orr forty dollars over and above what I have already given her 5th I give and bequeath to my beloved daughter Issabella Williamson five dollars over and above what I have already given her 6th I give and bequeath to my beloved daughter Sarah Bell one third part of a negro girl Patsey after the decease of my wife Jane Bell and in addition to what I have already given her 7th I give and bequeath to my beloved daughter Martha Bell, now single, two thirds of the negro girl Patsey as named before after the decease of my wife one horse, saddle, and bridle that she now claims, also the team and all the apparatus that belongs to the same, also one dressing table, two cows and calves, two ewes and lambs, one good bed and furniture and bedstead. 8th I give and bequeath to my beloved son Samuel Green Bell twenty dollars besides what I have already given him. 9th I give and bequeath to my beloved son James Bell thirty five dollars over and above what I have already given him. 10th I give and bequeath to my beloved son Robert Bell sixty dollars over and above what I have already given him. 11th I give and bequeath to my beloved son Thomas Bell the plantation whereon I now live with all the appurtenances thereto belonging also the horse he now claims, saddle, and bridles, also the following tools: two ploughs, two axes, two weeding hoes, one matlock, one Harrow, two pairs of drawing chains, in consequence of which, he, the said Thomas Bell, is to provide every necessary for the support of his aged mother during her natural life and he, the said Thomas, also have the benefit and labour of a certain negro man slave by the name of Charles for one year after the death of his mother and at the espiration of said Term the above negro is to be sold at twelve months credit and be it further ordained that and know that the said Thomas Bell is to have my wagon and the gear that belongs her. And if the sale of the balance of my perishable property should amount to more than the different sums named to each of my children then let the same be divided amongst the children if less then the same be so divided in proportion. Said Thos Bell is to pay fifty dollars for one half of the still and vessels or sell the same and let one half go to the rest of the legatees. And further, it is my will and desire that all my property not named in this my last will and testament shall be immediately sold after my decease and that one half of the expence of a lawsuit which my tow sons John and James is like to be engaged in about a tract of land I give them. And I do hereby constitute and appoint my tow sons John and Thomas Bells and Charles Hays as my executors of this my last will and Testament. In witness whereof I have here unto set my hand and seal this 18th day of September, 1819. Samuel Bell Test Thomas Williamson, John Bell, Thomas Bell – State of Tennessee Davidson County Court January Sessions 1821 The Last will and Testament of Samuel Bell deceased being exhibited in court for probate was proven thus: Thomas Williamson, John Bell and Thomas Bell the subscribing Witness being duly sworn say they became such in the presence of the testator and at his request and in the presence of each other that they verily believe he was of sound mind and memory at the time of executing said paper writing. Additional Comments: This is a direct transcription of Samuel Bell's recorded will, transcribed May 2008. Samuel Bell and his brother Captain Robert Bell came to the Middle Tennessee area when it was still a part of North Carolina, sometime between 1785 and 1790, from Guilford County, North Carolina. Samuel Bell's property was near the Davidson/Rutherford County line.
