March 18, 1889 Page 70 THE STATE Vs /DISTRUBING PUBLIC WORSHIP EMELINE ATNIP and “MORNING” ALLEN Came the Atty. General for the State and Defts in proper person who the Atty. General enters a Nolle Prosequi in the case upon Defts securing the cost less the taxes. Then came defts with H. G. ATNIP their securities and assumed the costs aforesaid and confessed judgment for the payment of the same. It is adjudged by the Court that the State recover of Defts and said security the aforesaid for which fifa issue. Fifa: (FIERI-FACIAS (FI-FA) A directive by a High Court to a sheriff to seize sufficient goods of a debtor to satisfy judgment debt.) Nolle Prosequi: An entry made on the record, by which the prosecutor or plaintiff declares that he will proceed no further. TAYLOR /CARRYING PISTOL FRANCIS ROBERTS /LEWDNESS WM. HOLLY and MARY TIPPETT /LEWDNESS HAMP ATNIP /CARRYING PISTOL In these cases on motion of the Atty. General and it appearing to the Court that two Capiases have been issued for each Defts and returned “not to be found.” Showing the Defts have fled the Country. It is ordered by the Court that these cases be retired from the docket but not dismissed and that DeKalb County pay the State cost in said cases when properly taxed and certified. This day came the Grand Jury and filed in open Court the following Presentments to wit: A Presentment against BILL MCCARTY for Carrying a Pistol, signed by all the members of the Grand Jury. A Presentment against GEORGE MCCARTY for Carrying a Pistol, signed by all the members of the Grand Jury.
