Bennett of the county of Smith and State aforsaid of their part I Benjamin Bennett of the county of Smith and State aforesaid of the their part Witness that the said John M. Bennett for and consideration of the sum of one hundred and fifteen dollars to him on hand paid by the said Benamin Bennett the recipt whereof he do himself actknowledge himself, sales for have granded, bargained and sold and by those presents granted, bargain and sold to the said Benjamin Bennett his heirs and assigns forever ten acres of land lying and being in Smith County State of Tennessee on the North fork of Dismal Creek a branch of Smith Fork of the Creeks fork of Cumberland River beginning at a beech on the south side of said creek running thence North twenty eight and six tenths poles to a beech thence west fifty six poles to backeye and beech on each side of a path thence south twenty eight six tenth poles to an ash thence east fifty six poles to the beginning to have and to hold the said ten acres of land unto the said Benjamin Bennett his heirs and forever and that John M. Bennett do for himself, his heirs Excutors as much as ??? and permission ? part through with this??? said Benjamin Bennett his heirs and asigns forever against the claim in Witness Witnessed, Sealed and delivered in presence of us William Bennett, JOHN HICKS, Reuben Johnson, John Yeargin, William ?. Thomas Coopwood (or Copewood?) , John M. Bennett (seal) Additional Comments: This deed of protery was once in Smith Co But is DEKALB Co Now Also This deed is the ONLY PROOF That I have so far that my 4th GGF JOHN HICKS was in Smith/Dekalb Co Tn. John married Nancy Bennett Marriage Bond Sept 1810 in Brunswick Co Va. Alot of Bennetts moved to Smith? later to became Dekalb Co TN. Nancy is listed in 1820 Smith Co Census as Ann Hicks (she was listed in the Salem Bapt. Chuch 1815. I do believe that John Hicks died before the 1820 Census. Thank You. And Hope this helps someone.
