This day came into open Court JARMON KOONCE and produced a certificate for and under the hand of the Coroner of Fayette County,State of Tennessee of his election for County Court Clerk of said County for the next insuing four years,and entered into bonds as follows and was duly qualified as the law prescribes VIZ: Know all men by these presents that we,JARMON KOONCE, WILLIE CROOK, JOSEAH HIGGERSON and WILLIAM A.JONES are held and bound unto his Excelency JAMES A.POLK,Governor in and over the State of Tennessee and his successors in Office of the sum of Ten Thousand Dollars,the payment of which will and truly to be made we and each of us bind ourselves,our heirs,Executors and Administrators jointly and severally firmly by these presents sealed with our seals and dated this 6th day of April 1840.(This continues on Page 2 also,and states that JARMON KOONCE was elected Collector of Public Taxes. Ordered by the Court that ROBERT THORTON be appointed overseer in place of GEORGE KIRBY,former Overseer on the road from Somerville to Hayses Bridge on Wolf River and have all the men under said GEORGE KIRBY. PAGE 57; MONDAY 5TH OCTOBER 1840. Ordered by the Court that JOHN BOYD, BENJ.H.BUCKLEY, KENARD BOYED, JOHN C.SPENCE, GEORGE RIVES, DAVID DOUGLASS, WILLIE CROOK, and EDWIN EDWARDS be appointed a Jury of View to lay out a road on or near the old rout leaving the Stage road about two and 1/2 miles east of Somerville between the plantations of JOHN BOYED and ALEXANDER STEWART leading to DOCTS.JAMES WRIGHT's Mills on Loosi Hatchee a few hundred yards above DUTYE's old Mill cite and make their report to this Court of the Same next term. PAGE 119; MONDAY 5TH APRIL 1841. An application to the Court,it was ordered that THOMAS AVITTE leave his stock mark recorded as follows: A crop in the write ear and slit in the left. PAGE 134; MONDAY 3RD MAY 1841. This day was returned into open Court the report of WILLY CROOK, DAVID DOUGLAS, EDWIN EDWARDS, R.BOYD, JOHN BAGGETT, and BENJ.H.BUCKLEY,A Jury of Review appointed at the January Term part and have made their Report as follows told it: We,the undersigned do agree and Say that the old road shall be opened and run and leaving McSTEWARD's crop lot on the left as witness our hand and seals.Received by Court.WILLIAM BURTON CLEVIS. Ordered by the Court that WYLIE CROOK be allowed the sum of Ten Dollars for repairs done on the Bridge over Crook Creek on the Stage road and that the County Trustee pay the same out of any moneys in his hands not other wise approprated. Ordered by the Court that JOHN L.DAY be appointed Overseer on the Stage road from Somerville to Bolivar Commencing at said Somerville and work to the West end of the bridge over Creek and to work the following hands VIZ: (included one hand of WYLIE CROOK.) Ordered by the Court that THOMAS AVETTE, JOHN VANPELT and OBIDEAH FLETCHER be appointed Commissioners to lay off to NANCY RAMSEY her years provisions as widow relict of RICHARD RAMSEY,dec'd,and report to the next term of this Court. PAGE 236; MONDAY 7th MARCH 1842. There came into Open Court, THOMAS AVERTT, O.FLETCHER and JOHN VANPELT, Commissioners appointed at the December Term last past to sit apart to NANCY RAMSEY her years allowance as widow reliect of RICHARD RAMSEY,dec'd,and have made this report as follows___WE,the undersigned freeholders of Fayette County after being duly Sworn have proceeded to set apart to NANCY RAMSEY,widow of RICHARD RAMSEY,dec'd.,so much of the crop and provisions on hand as will be sufficiant in our opinion to support her and her family one year from the Death of her said husband.WE set apart to her for said purposes the following articles to wit: 2000 pounds pork including what the law allowed a widow and 50 Barrels corn also including what the law allowed a widow,also 2__ stacks Fodder,also 3 barrels flour, 150 pounds sugar and 100 lbs.Coffee,2 sacks salt,2 pounds butter,2 lbs.Alspice,2 lbs gingar,4 barrels white sugar,100 pounds pick cotton,10 lbs.wool. 12 December 1841.THOS.AVETT (seal), O.FLETCHER (seal). On petition of WILLIAM HEAD, JOHN BROWN and THOMAS AVETT,praying the privilege of erecting a turn pike across Wolf River and bottom where the State Line road crosses said stream at Moscow,it was ordered by the Court that said petition be received and filed and that the clerk make the necessary publication as required by Act of Assembly.It was furthered ordered by the Court that JAMES HASLET, COLLIN TURNER, and WINFIELD,ESQ.,members of this Court be appointed Commissioners on behalf of this Court to examine and report to the next term of this Court whether it is practicable to keep up said road where it crosses said stream by the appointment of an overseer and the assignmant of hands,if not then to view the extent of work required to be done to said turno=pike and report to this Court what would be a resonable length of time for the grant of the privilege of erecting a turnpike and the amount of tole that ought to be charged for crossing the same. PAGE 250; TUESDAY 8TH MARCH 1842. This day came into open Court the following Revenue Commissioner for said County and returned his tax list to wit: THOMAS AVETT for 12th District. PAGE 260; MONDAY 4TH APRIL 1842. Ordered by the Court that WILLIE CROOK be allowed the sum of twenty-five dollars for repairing and placing back a bridhe washed off the levee on the road from Bolivar to Somerville and repairing the levee on said road and also the sum of two dollard for a bridge repair over the creek near said CROOK and said road to Boliver and that the County Trustee pay the same out of any money in his hands not otherwise appropriated. Ordered by the Court that MARGARET SOUTHERN be allowed the sum of eighty dollsre for keeping,boarding and clothing SOFRONIS SOUTHERN,a lunatic pauper of this County for the year 1842,and that the County Trustrr pay the same out of any money in his hands not otherwise appropriated. Ordered by the Court that WILEY CROOK be allowed the sum of ten dollars for repairs done on a bridge over a creek near his house on the Stage Road and that the County Trustee pay the same out of any money in his hands not otherwise appropriated. Ordered by the Court that ISAAC W.WHITTAKER be appointed Overseer in place of BENJAMIN H.BUCKLEY,former Overseer on that part of the Stage road from Somerville to Bolivar. PAGE 458; MONDAY 6TH NOVEMBER 1843. JAMES TILLER vs SQUIRE HOGAN and NANCY HOGAN. This day cae the parties and it appearing to the Court that a writ issued in pursuance with the order made in this Cause at the last term and was by the Sheriff of Fayette County duly executed upon the defendents,SQUIRE HOGAN and NANCY HOGAN and it further appearing to the Court that at the December Term 1841 of this Court Administration on the Estate of Richard RAMSEY dec'd was granted to the said NANCY,then NANCY RAMSEY and since intermarried with the defendent SQUIRE HOGAN and it further appearing to the Court that the plaintiff,JAMES TILLER,together with JOHN VANPELT and ANDREW E.FORD entered into bond before this Court with the said NANCY and as her surety for the said Administration and the defendents,SQUIRE HOGAN and NANCY HOGAN,having come into Court on this day and resigned with the said Administration by the permission and order of this Court,the Court doth further order that THOMAS AVETTE be and he is hereby appointed Administrator debonis non of the said RICHARD RAMSEY,deceased.whereupon the said THOMAS AVITT entered into bond as such Adminstrator in the sum of Eight Thousand Dollars with L___HOOKS and WILLIAM P.SIMMONS as his surities which said bond was executed and acknowledged in Open Court by the said AVITT, HOOKS, and SIMMONS and the said THOMAS AVETTE was sworn as such Administrator of said RICHARD RAMSEY,deceased. PAGE 462; TUESDAY 7TH NOVEMBER 1843.This day came into open Court THOMAS AVIT Administrator De Bonis non of the estate of RICHARD RAMSEY dec'd and returned into Court an Inventory of Notes and assesr of said Estate which was received and ordered to be recordered. PAGE 464; MONDAY 4TH DECEMBER 1843. Ordered by the Court that JESSE S.GRIDER, THOMAS AVIT, WM.TEAGUE be appointed Commissioners to lay off to MARY ROSSER,widow of WILLIAM ROSSER,dec'd,a years' provision from the decease of the said husband for here and her family out of the estate of said deceased they being as appears to the Court unconnected to said widow and make their report to the next term of Court. PAGE 482; MONDAY 1ST JANUARY 1844. This day was produced in open Court the report of THOMAS PATTON,one of the Commissioners appointed to let out the repares of the Bridge on the Stage road across the Creek at WILLIE CROOKS to the lowest bidder and have made their report as follows: WE,the Commissioners appointed by the Court to let out the Bridge at W.CROOK on the Stageroad have completed with our commission and have set it out to W.CROOK at Seventynine Dollars fifty Cents,he the said CROOK has repaired the bridge and we the Commissioners have viewed it in good order.THOMAS PATTON. R.W.LOVING,Clerk. Ordered by the Court that WILLIE CROOK be allowed the sum of Seventy nine dollars and fifty cents for building a Bridge across CROOKS Creek on the Stage road from Somerville to Bolivar and that the County Trustee pay the same out of any money in his hand not otherwise appropriated. PAGE 486; MONDAY 5TH FEBRUARY 1844. Ordered by the Court that WILLIAM PATTON be appointed overseer in place of BENJAMIN BUCKLEY on the Stage road from Somerville to Bolivar . PAGE 510; TUESDAY MARCH 5,1844. This day came into open Court J.KOONCE and produced a certificate of his election as Clerk fron the Coroner of Fayette County,Tennessee and entered into bond in the words and figures following,to wit:Know all men by these presents that we,JARMON KOONCE, WILLIE CROOK, I.W.WHITAKER, JOSIAH HIGGASON, and WILLIAM RUFFIN are held and firmly bound unto his Excelency,JAMES C.JONES,Governor in and over the State of Tennessee and his Successors in office in the sum of Ten Thousand Dollars,the payment of which will and truly be made in and each of us bind ourselves,our heirs,executors and administrators Jointly and Severelly and firmly by these presents sealed with our seals and dated this 4th day of March,1844.The condition of the above obligation is such that whereas the above bound JARMON KOONCE has been duly elected Clerk of the County Court of Fayette County in the State of Tennessee.Now should the said JARMON KOONCE safly keep the records of the said office and the faithful discharge all the duties thereof then the above obligation is to be void.Otherwise to be and remain in full force and virtue.Signed,Sealed,and Delivered. KNOW ALL MEN by these presents,that in JARMON KOONCE, WILLIE CROOK, ISAAC W.WHITAKER, JOSIAH HIGGERSON and WILLIAM RUFFIN,all of the County of fayette and State of Tennessee are held and firmly bound unto JAMES C.JONES,Governor of the State of Tennessee for the time being and his successors in office for the use of the State in the sum of Six Thousand Dollars,the payment of which will and truly to be made,we bind ourselves,our heirs,executors,administratiors,Jointly and Severally firmly by these presents Sealed with our seals and dated this 4th day of March 1844. The Condition of the above obligation on these that whereas the above bound JARMON KOONCE has been duly and constitutionally Elected Clerk of the County Court and Collector of the Public Taxes from Merchants and Land and all taxes by him collected in said County of Fayette and State of Tennessee,and will and truly account for and pay over all taxes by him collected on the first day of November in each and every year so long as he may remain in office,the above obligation to be void otherwise to remain in full force and virtue. Ordered by the Court that C.W.(?) SWIFT be appointed Overseer of the road in place of JAS.B.EVERETT,dec'd,extended from the bridge between JNO.W.MAYO and JAMES____,to E.B.HILL near LaGrange and have former hands with GEO.WAPHINTON's and GEO.FRAZSER's,who have moved in the District of said road. PAGE 368; MONDAY 5TH APRIL 1847. A written instrument purporting to be the last will and testament of JAMES EVRETT,Sr.,dec'd,and thereupon came into Court,JAMES A.HOWARD and J.F.SIMMONS,subscribing witnesses thereto being first duly sworn,say that they were acquainted with JAMES B.ERVETT Sr.,the testator and that he acknowledged the execution of said will in their presence to be his last will and testament and they believe he was of sound mind at the time of his acknowledging the same,and that they signed it as witnesses in his presence.It was ordered by the Court that said Will be established and be entered of Record,And thereupon JAMES MAYO came into open Court and was appointed Executor with JOHN D.MAYO and WILLIAM Q(?).MAYO,his securties. Ordered by the Court that JOHN E.PERRY, SOLOMON CROOK, JAMES B.CROOK, A.F.COWAN,and THOMAS CULLUM,be appointed a Jury of View to view and make out a change on the Whiteville Road commencing at the East End of J.SIDDLES Lane running West some two or three hundreds yards intersecting the Oald Road and make a report to the next term of this Court. PAGE 445; MONDAY 6TH DECEMBER 1847.This day was produced in open Court the following report,WE,the Jury appointed at the November Term of the County Court after being duly sworn,have proceeded the view and make out said change leaving the Old Road at the End of said lane as prescribed in said Order and Intersect the Old Road by running some two or three hundred yards.Given under our hands and seals this 25th day of November 1847. COUNTY CLERK MINUTES VOLUME D OCTOBER 1848--AUGUST 1852~~~~~SEPTEMBER 1852--MARCH 1856 PAGE 5; MONDAY 2ND OCTOBER 1848.Ordered by the Court that THOMAS AVITT among others be appointed Commissioners to let out the rebuilding of the Moscow Bridge ove the Wolf River and the cost not to exceed $1200.00. PAGE 94; TUESDAY 3RD APRIL 1849. A paper writing purporting to be the last will and testament of THOMAS AVITT,dec'd,was proven in open Court and thereupon came in open Court,S.E.HOGAN and WILLIAM K.CURTIS,subscribing witnesses to the said paprt writing and who being first duly sworn depose and say that they were acquainted with THOMAS AVITT,the testator and that he acknowledged the same in their presence to be his last will and testament and they believe he was in sound and disposing mind and memory at the time of the signing of the same and they signed the said paper writing at the request and in the presence of the Testator and each other,and it is considered by the Court that said will be established and recorded. PAGE 94; TUESDAY 3RD APRIL 1849. And thereupon came into Open Court.W.H.AVITT,one of the Executors appointed in the Last Will and Testament of THOMAS AVETT,dec'd,and entered into Bond,himself as principal and gave WILLIAM P.SIMMONS, JAMES A.GOBER,and S.E.HOGAN as his securities in the sum of Thirty Six Thousand Dollars condition as the law directs and was duly sworn to carry out the contents of said will and make true returns of all such estate as may come to his hands.Said bond was Received by the Court and ordered to be entered of record and the securities came in Open Court and acknowledged themselves as such securties in said bond. Ordered by the Court that S.E.HOGAN, WILLIAM HEAD and BEVERLY ANDERSON be appointed Commissioners,who after being duly sworn to act impartially shall proceed to lay off and set apart so much of the crop,stock and provisions,money on hand or due as may be necessary for the support of MRS.SARAH AVITT until the expiration of one year after the death of her said husband and make report at the next term of this court on oath.
