And it appearing to the Court, that on the 10th day of December, 1842, Thomas AVERRT, before Seten HUDSPETH, Sheriff of Fayette County, Tennessee, executed his appeariance bond wherein, he acknowledged himself to owe the State of Tennessee One Thousand Dollars to be void, if he, the said Thomas AVERRT, should appear before the Judge of the Circuit Court at the Courthouse in the town of Somerville, Fayette County, on the first Thursday after the 3rd Monday in January next, thereafter on a charge of unlawfully furnishing negroes with free papers, for the purpose of aiding and assisting said slaves in running away from their masters, and abide by such sentance as should be pronounced by said Court in the premises, or surrender himself into custody and not depart without leave of the Court--And it further appearingto the Court that afterwards at the January Term of said Court 1843, the said Thomas AVERRT, being solemnly called to come into Court and answer said charge, and coming not, but making default, was by the Court, adjudged to forfeit and pay the State of Tennessee the sum of One Thousand Dollars, according to the tenor and effect of his said bond, unless he showed good cause to the contrary, at the next term--And it further appearing that a scire facias and also an alias scire facias have issued from said Court, to notify said Defendant of the premises, and warn him to appear in said Court, and show cause why the State of Tennessee shall not have execution against him for the amount of the recovery, so had as aforesaid against him, and that said scire facias---? Come into the hands of the Sheriff of Fayette County, and by him, that he has returned on each of them, that Thomas AVERRT is not to be found-- And the said Thomas AVERRT, being now here again, solemnly called to come into Court, and answer the said scine facias, but coming not and making default. It is therefore considered by the Court that the said motion be sustained, and that the aforesaid judgement for One Thousand Dollars, be made absolute, and that the State of Tennessee, recover the same, together with the costs in this behalf accuring for which execution shall issue.
