The following depositions taken before John G. Enocks, Clerk and to collate the advancements in the above court to the heirs on the 6th day of March 1869. J.L.B. Williams and wife. Being the first Witness states: 1. I am a son-in-law of the late Anthony Stewart and married his daughter Margaret Jane. 2. What advancements did you ore your wife receive in the life time of Anthony Stewart, dec- also state their value- answers: We received a bed and bed clothing and stand. Value at the time received 18.00, one yearling calf 2.00, 1 lamb 1.00, 1 saddle 18.00. The above is all the advancements we received March 6, 1869 JLB Williams H.P. Stewart next being duly sworn deposed as follows 1. Are you a heirs of Anthony Stewart, Dec.. answer I am a son. 2. Please state the amount of advancements you received from your father in his life time and also their value 1 saddle 18.00 The above is all the advancements I have ever received. H. P. Stewart. Samuel Stewart next being duly sworn deposed as follows 1. Are you a son and heir of Anthony Stewart Dec.. answers, I am. 2. What advancements did you receive in his life time and what was its value ans- 1 horse 125.00 rent for land 100.00 the above was all the advancements I ever received from his estate. S. W. Stewart J. C. Looney next being duly sworn deposed as follows 1. Are you an heir at Law of Anthony Stewart, Dec.. Ans - I am and married his daughter, Sarah. 2. What advancements did you receive during his life time? And what is their value? Ans - I received one cow valued 15.00, 1 hog valued 3.00, 1 saddle 18.00, 1 set of plates and tea cups and saucers 1.50, 1 bed and stead clothing 15.00. The above was all the advancements I have received. J. C. Looney Isaac G. Stewart next being duly sworn. Deposed as follows, 1. Are you an heir of Anthony Stewart, Dec.? Ans - I am a son. 2. State what amount of advancements you received in the life time of Anthony Stewart , dec, and their value. ans - I received a horse valued 100.00, 1 saddle valued 15.00, 1 cow, 10.00, 1 gilt 5.00, 1 bed and clothing 15.00. The above was all the advancement I have every received. I. G. Stewart Benj. Sells next being duly sworn deposed as follows, 1. Are you and heir at Law of Anthony Stewart, Dec.? I am. I married his daughter, Mary Ann. 2. State whether you ever received an advancement in the life time of Anthony Stewart and the amount of value. 1 bed and clothing and stead 15.00, cow and calf 15.00, 1 sow and piglets 5.00, 1 saddle 18.00, 1 set of plates tea cups and sauces 1.00. The above was all the advancements we ever received to my knowledge. Benjamin Sells. Benjamin Elliott next being duly sworn deposed as follows, 1. State whether you ever ___ Elizabeth Elliott formerly Elizabeth Stewart Stole whether she ever received any advancements if so what and their value from her father Anthony, Dec. Stewart in his life time. 1 bed and clothing and stead 15.00 1 cow 12.00 1 saddle 18.00 1 sow The above was all the advancement I ever received. Elizabeth say she had received. B. Elliott, Sr. Fielding Rice being the next witness being duly sworn deposed as follows, 1. State whether or not you was acquainted with Anthony Stewart in his life time. ans - I was. 2. State also if you knew Bledsoe Stewart in his life time. ans - yes, Sir. 3. State whether you ever knew of him receiving any thing from his father, ___ the ___ of advancements if so what and their value. ans - he received 1 horse 125.00 4. State whether you was acquainted with John Stewart, Dec.. ans. I was. 5. Do you know what amount of advancements he received from his father Anthony Stewart in his life time and the value of the same. ans - I heard John Stewart, Dec.. say in his life time that he had received 1 horse, which was worth 100.00, 1 saddle, and bridle 20.00. Fielding Rice J. C. Looney being so sworn deposed as follows. 1 Do you know of any advancements received by E. G. Stewart from Anthony Stewart in his life time and if so what and the value. 1 horse 100.00, 1 saddle, 18.00 2. Do you know of any advancements made to Anthony Stewart, Jr. from his father Anthony Stewart, Sr., dec - in his life time if so what and the value of the same. 1 horse 125.00 J. C. Looney The above deposition was sworn before me in the presents of James G. Enocks guardian ___ ____ and sworn to be me. March 6, 1869. From A. Sell et ols State of Tennessee v Franklin County Court Anthony Stewart et ols. The deposition of Mrs. Margaret Stewart. Taken upon notice on the 3rd day of April 1869. Before the County Court Clerk and in presence of the guardian _______ 1. Question. State what is the relation between you and the parties to this suit. ans - I am the widow of Anthony Stewart, Sr, dec- 2. State whether he had been married twice or not if so whether you was not the second wife. ans - He was married twice I was the second and last wife. 3. State how many children he had by his first wife and their names, also whether they are living or dead. Also state how many of them had heirs at the time of Anthony Stewart Sr. death. ans - He had nine children, namely, Blecher Stewart, John Stewart, Wm. Stewart (died without issue), Bethie Elliott who intermarried with Benj. Elliott, Mary Ann Sells who intermarried with Benj Sells, Syamantha Stewart who married Richard Stewart, Sallie Looney who intermarried with ___ Looney, Anthony Stewart, Enoch Stewart. 4. State how may children he had by you and their names of these living or who died with issue. ans - I have five living the rest died with out issue. Namely, Marg. Jane Williams who intermarried with J. LB. Williams, Isaac Stewart, H. P Stewart, Sam. Stewart, Ann Williams who intermarried with Flint Williams. 5. State whether these above names are all of the heirs of Anthony Stewart, Sr., dec - Ans - they are. 6. State the amount of advancements received by each heirs from Anthony Stewart, Sr. dec. during his live time and what it consisted of. ans - I know what he give to all of the heirs except Blecher Stewart and I was informed often that he gave him what he did the rest. He give to John Stewart 1 Horse and saddle 1 cow and calf 1 sow 1 bed, bed stead, and clothing He also give to his sons, Anthony and Enoch the same as he give John. 7. State what he give to the girls by his first wife. ans - He gave to Sells, Looney, Stewart, and Elliotts wives each 1 cow and calf 1 side saddle 1 bed, bed stead, and clothing 1 set of plates 1 set of cups and saucers 1 sow and pigs 8. State what he gave to the children by you ans - Jane wife of J. LB. Williams he advanced her 1 bed, bed stead, and clothing 1 side saddle 1 calf 1 lamb To Isaac Stewart he advanced 1 horse and saddle 1 cow and calf 1 sow Bed, Bed stead and clothing. To H. P. Stewart He never gave nothing but 1 saddle To Sam Stewart he advanced 1 horse To Ann Williams he advanced 1 saddle 9. State whether they were not all nearly _____ in value at the time he made such advancements considering the advance decreased in price. ans - His intention was to make them all equal in his advancements.
