Carroll Be it remembered that on this day came on this cause for further hearing upon Bill answer of minor defendant by her guardian ad litum T. J. Carthel, Esq and report of the Clerk and Master which report is unexcepted to and is in all things confirmed when it appeared to the Court from said report that the tract of land of land described in the pleadings cannot be divided without injury to the parties and that it is manifestly to the interest of all the parties that said land should be sold for partition. It also appeared to the court that said Elizabeth is entitled to her dower interest in said land and that she consents to have her dower interest sold then dower paid her out of the proceeds and it also appeared from the report of the Clerk and Master that her dower cannot be laid off to her out of the land without manifest injury to all the parties and that it is to the manifest interest of all the parties to have the land sold in a body. It is therefore ordained, adjudged, and decreed by the Court that the Clerk and Master after advertising according to law proceed to sell at public auction to the highest bidder the land described in the pleadings and that he sell it in the Town of Rutherford Station in this state and county. That if be sold on the following terms, one third 25th December 1867, the balance on a credit of one and two years in two equal payments, that a lein be retained with two good securities for the payment of the purchase money and that he report to the December Term of this court.
