It appeared to the Court that J.W. Carroll departed this life intestate as stated in the pleadings, that Elizabeth Carroll is his widow that Charles Carroll is his Administrator and the other complainants with said Charles are his only children that defendant Mary E is his granddaughter and that said complainants and defendants are his only heirs at law. That he died [ ] of the tract of land described in the pleadings. But it not appearing to the satisfaction of the court that is is to the interest of all the parties to have said land sold for partition. It is therefore decreed by the Court that the Clerk and Master take proof to see whether or not said land can be divided without injury to the parties concerned or whether it is manifestly to their interest to have it sold and that the Clerk report to this term of the Court.
