June 7, 1886; Henry O’Daniel vs Robt Carroll, Gibson County Court Minutes Vol R April 1885-Nov 1886, p. 547; LDS Tape # 1008134. In this cause it appearing to the court that petitioner Henry O’Daniel is the regular guardian of Robert E., Emma and Dora Carroll, children of Chas Carroll deceased and that he desires to resign his trust as such Guardian, it further appearing that as such Guardian he has made his settlements and duly passed his accounts with the Clerk of this Court and that said settlements show that he has a balance in his hands due his ward Robert E. Carroll of $30.19 and a balance due his ward Emma of $25.52 and a balance due the Guardian by his ward Dora of $54.59 sums due by the Guardian he is ready to pay over upon his resignation being accepted and his successor appointed and it further appearing that P.H. Carroll is willing to become Guardian of Emma and Dora Carroll in the stead of said O’Daniel and that Emma who is 13 years old is willing for said P.H. Carroll to become her Guardian and that the maid Dora is only about 8 years old and too young to choose a Guardian and it further appearing that said P.H. Carroll is a suitable person to act as such Guardian and that it is more convenient for him to discharge the duties of the Guardianship than for said O’Daniel to do so. And it further appearing from proof that said Robt E. Carroll will be 21 years old on the 6th day of July 1886 and the Court being of opinion that it is best not to appoint a new guardian for him. It is therefore ordered adjudged and decreed by the Court that the resignation of petitioner O’Daniel as Guardian aforesaid be and the same is hereby accepted and that said O’Daniel be discharged from further duties as such guardian. It is therefore ordered that P.H. Carroll be appointed the Guardian of said Emma and Dora Carroll in the room and stead of said O’Daniel and that upon his entering into bond and qualifying as such Guardian said O’Daniel pay over to him the amts due said ward Emma as aforesaid taking his receipts. Therefore came into open court P.H. Carroll and entered into bond in the [ ? ] sum of $1300 as the Guardian of said Emma and Dora Carroll [can’t make out the rest but doesn’t appear to be crucial]. NOTE: On Feb 4, 1884 Henry O’Daniel was appointed Guardian of Emma and Dora Carroll, minor heirs of Chas and Emma Carroll, decd. From Gibson County Court Minutes, Feb 1884, p. 14; LDS Tape # 1008133. Carroll were his securities. Page 62 of Gibson County Court Records. Submitted to Gibson County GenWeb Site in 2009 by Frank Edwards, 136 Rutgers Circle Crossville, TN 38558 ---
