Fleming, Oct 1, 1888. Gibson County Court Minutes Vol T, July 1888-July 1889; LDS Tape # 1008135. Interlocutory Decree; Jon R Fleming et al vs W. C. Fleming et at. Be it remembered that this case came to be heard on this the 1st day of Oct 1888 before the Hon W.T. McKee[ ? ] when it appeared to the court that H.W. Fleming Sr died intestate in Gibson County Tennessee about the time stated in the petition leaving as his only children and heirs at law, Jon R. Fleming, George W. Fleming, H.W. Fleming Jr., M.E. Fleming now the wife of [something like “complainant” ] H. Alphin, E.A. Fleming, now the wife of [”complainant”] W. C. Crane, S. C. Fleming, now the wife of [”complainant”] W. B. Tyson and Chas Fleming. It further appearing to the court that Chas Fleming is now dead and that he left as his only children and heirs at law the defendants W. C. Fleming , Nettie Myrd Fleming and Clyde M. Fleming, it further appearing to the court that the said H.W. Fleming was at the time of his death the owner in fee of the following described tract of land set out in the petition, lying and being in the 10th Civil Dist of Gisbon County, TN and bounded on the north by the land of E.H. Tisdale on the south by the land of W.W. Smith and Fleming heirs, on the east by the lands of E.B. Kerr and A.A. Fleming and on the west by the lands of W.W. Smith and W.M. Rutledge, containing 100 acres. It further appearing to the court that Jon R. Fleming, Geo Fleming, H.W. Fleming Jr., M.E. Alphin, wife of H. Alphin, E.A. Crane, wife of W.C. Crane and S.C. Tyson, wife of W.B. Tyson are each entitled to a one seventh interest in the said tract or parcel of land and that [Defts] W. C. Fleming, Nettie Myrd Fleming and Clyde Fleming are jointly entitled to their deceased father’s undivided interest in the said land and that the [complts] and [defts] are now the owners as tenants in common of the said tract or parcel of land and it further appearing to the court that said land is so situated that it cannot be divided in kind without great injury to the parties in interest and that it is manifestly to the interest of all the parties that said land should be sold for partition. It is therefore ordered and decreed by the court that the clerk of this court after advertising said land as the law directs sell the same at public auction at the court house door in the town of Trenton, TN to the highest and best bidder for 1/3 cash and the balance in two equal payments on a credit of 1 to 2 years taking notes for the deferred payments with good personal security and retaining a lien on the land to secure the payment of said notes.
