Fleming Sr., Oct 1888. Final Decree; J.R. Fleming et al vs W.C. Fleming et al; Nov 5, 1888; Gibson County Court Minutes, Vol T, July 1888-July 1889, page 161; LDS Tape # 1008134. Be it remembered that this cause came on to be heard before the Hon W. F. McKee Chairman of County Court of said county on this the 5th of Nov 1888 upon the [Report ? ] of the Clerk & Commissioner to the present [ Term ? ] of this [ Court ? ] which [Report ? ] is in words and figures as follows: To the Honorable W. F. McKee- Trenton, Tenn. Report of the Clerk to the Nov Term, 1888. The undersigned would respectfully report that in obedience to the interlocutory decree rendered in this case at the Oct term 1888 of this court after giving notice by advertisement as required by law in the Gibson County Herald he proceeded on the 27 day of Oct 1888 to sell at public sale to the highest and best bidder at the court house door in the Town of Trenton, TN upon the terms directed in said [decree ? ], the tract of land therein mentioned to wit situated in the 10th civil dist of Gibson County, TN and bordered as follows on the north by the lands of E.H. Tisdale, on the south by the lands of W.W. Smith and Flemings heirs, on the east by the lands of E.B. Kerr and A.A. Fleming on the West by the lands of W.W.Smith and Wm N. Rutledge containing 100 acres. When W.B. Tyson and H.W. Fleming became the purchasers thereof at the price of $2025 that being the highest and best bid for the sum of $675 of which was paid in cash and executed their two separate notes each for $675 with H. Alphin their security payable at one and two years from date thereof for the balance of the unpaid purchase money, and a lien was [ retained? ] on said land for the same. All of which is respectfully submitted this 27 day of Oct 1888. A.H. Foster, Clerk It is therefore ordered adjudged and decreed by the court that all the rights, titles and interest of all the parties in and with the above described tract of land be and the same is hereby directed each of them and vested in the said W.B. Tyson and H.W. Fleming, subject to the lien for the unpaid purchase money. It is further ordered and adjudged by the court that the clerk of this court retain all cash payments including a fee of $25 for T.L. Mosely, Atty for partitions and $10 as a fee for A. Kellough, guardian ad litum for minor dependents and that said fees [ balance was not copied]. NOTE: Apparently, Charles Fleming, a son of Hiram W. Fleming died earlier, leaving children: William C., Clyde M., and Nettie Myrd Fleming. On Sept 3, 1888 A. Kellough was appointed guardian of these children (See Gibson County Court Minutes, Vol S, Nov 1886-June 1888, p. 120, and LDS Tape #1008134). So, in effect, H.W. Fleming, Jr. (Hiram Sr.’s son) and W.B. Tyson (Hiram Sr.’s son-in-law) are buying the land.
