Harper for the sum of one dollar to me paid and the other considerations herein after mentioned fifty barrels of corn, fifteen hundred pounds of pork, three feather beds, bedsteads and bed clothing, one falling leaf table, twelve head of sheep, one gray horse supposed to be nine or ten years old, one sorrel colt two years old, one small two horse wagon and fifteen head of stock hogs and seven head of cattle, to have and to hold the said note the said Henry D. Harper his heirs and assigns forever. I do covenant with the said Henry D. Harper that I (Page 104) am lawfully seized of said property & have a good right to convey it and that the same is unencumbered. I do further covenant and bind myself to defend my right to the same against the lawful claim of all and every person or persons, whatsoever. But this deed is made for the following purposes and trust and for no other purpose that is to say that I am indebted to one Calvin J. Boon in the sum of one hundred and fifty seven dollars & 50 cents under seal of this date due the 25th day of December 1843 the above described note of one hundred and fifty seven dollars and 50 cents was made payable to Elisha Billingsby and since fallen into the hands of Calvin J. Boon the above described note was made by myself to Elisha Billingsby and was endorsed by Henry D. Harper, Willis Bennett & Green Chandler as my securities and I am desirous to secure and make certain the payment of the same, now if I should pay the said debt by the 25th day of December 1844 then this deed to be void but if I should not then the said Henry D. Harper as trustee after giving twenty days notice in writing at the Court House door of Gibson County and at the Election Ground of the Twelfth District and three other public places in the neighborhood may expose the said property to public sale and sell it to the highest bidder on a credit of six months and appropriate the proceeds first to the payment of the necessary expenses and costs, secondly to the satisfaction of said one hundred and fifty seven dollars & 50 cents and thirdly to pay the balance if any there be to me this 6th day of January 1844.
