Penny petition for Dower Be it remembered that on this day came on this cause open petition exhibit proof & @(?) when if appeared to the cocent that on the day of 1861 one James Penny died intestate in Gibson County having (fre ti tianem??) as his widow & the following as his children all of whom are minors & with out any guardian be with Wm Penny, Sarah Penny, Martha Penny & Susan F. Penny & Jm D McDowell has been qualified as his administrator that said decedent owned the land mentioned in the petition at the time of his death that Petitioner is entitled than have Dower assigned her and of said land that said administrator has been dult notified of his appreciation. It is therefore ordered by the court that Els Evie, H D Harper, GP Wade, WG Blakemore, and EJ Arnold convey sum vey on be & are hereby appointed commissioners any three of whom with the county surveyor may act to lay off and assign to petitioner then dower out one third of said land including the mansion House considering quality and quantity & that they report to the next court. Ordered by the court that WC Callis Executor of Wilkins Collier deed be allowed until 1st of January 1863 to settle up said estate. We the undersigned jury of vein (sic) appointed at aforementioned term of this court beg leave to make the following to wit that the road be reduced down to twenty feet wide & that the same be on the line between A Davis & WC Crawford & that the road be on the land of A Davis this 7 day of April 1862
