All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/tn/tnfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Deborah Parks dtparks58@gmail.com June 5, 2013, 10:59 am Source: Gibson County Tennessee Will Book G Written: November 23, 1880 Will of Ellis Davis I Ellis Davis, being of sound mind and disposing memory, do make and publish this my last will and testament hereby evoking all others. 1st It is my will that at my death or so soon thereafter convenient, my debts all be paid by my executor out of any money that may be on hand. 2nd I give to my beloved wife Parthenia Elizabeth Davis all of my land consisting of about 225 acres during her natural life to be used and enjoyed by her so long as she may live, but out of the profits of my land above given to my wife the fencing around the farm is to be kept in good repair and the taxes are to be paid by my wife out of the said profits of said land during her life. 3rd I give to Sarah Davis (Col), Fannie Davis (Col), & Elizabeth Davis (Col), all daughters of Andrew Davis (Col) who was formerly a slave and owned by me, all my land after the death of my wife but they nor either of them are to have any interest in said land during the life of my wife, but if the said Sarah, Fannie, Elizabeth or either of them should die without children or the descendant of children then the share that is given to such one is to be divided between the two surviving ones or their children, and in the event that any two of the above named girls should die without children, or the descendants of children, then the surviving one or her children or descendants of children are to have all the property given to all of them, the said property is to go to them absolutely free from any debts and constraints of any husbands that any of them may have in the future and also to be free from the control of Andrew Davis (Col). 4th I give to my beloved wife all my personal property of every description or the stock of the same, but it is my will that all my stock of every description be sold by my executor except it be a cow and calf or sow and pigs that my wife may devise to keep and the proceeds of the sale to be paid my wife absolutely be disposed of by her as she may desire, and this is also to include all that I may have my personal property of any kind, notes and accounts, except my household and kitchen furniture. 5th I give to my beloved wife during her natural life all of my household and kitchen furniture of every description and at her death I give to Sallie Jones, sister of my wife, one bed and bed stead and bed ticking, wood, and Wilson Sewing Machine and all the balance of my household and kitchen furniture to be divided between Sarah, Fannie, & Elizabeth Davis (Cold) equally in the same way as the land is to be divided should any of them die without children or descendants of children. I hereby appoint my friend and neighbor I.J. Charles to carry out this my last will and testament on this day November 23, 1880.
