Moore, Robt. H. Moore, M. C. Moore & Sam’l Cowan & wife Mary E. formerly Mary E. Moore & Wm. M. Kinningham & wife Louisa J. formerly Louisa J. Moore, citizens of Franklin co. Tenn. vs Wm Holland & wife Eliza formerly Eliza Moore, Elizabeth Moore, Virginia Moore, John Moore & Josephine Moore last three minors under 21 yrs of age, citizens of Franklin Co. Tenn. & all children of Alexander Moore, all except said Wm Holland Defts - Your petitioners respectfully show unto your Worship that on the 1st day of Feby 1867, James M. Moore departed this life intestate in Gibson Co. Tenn unmarried & without any issue, James Russel of said Co. was appointed the Admr of said intestate’s estate, by said County Court & duly qualified - Said intestate left the following heirs, to wit your petitioners said John H. Robt. H. & M. C. Moore his brothers & Samuel Cowan & wife Mary E. formerly Mary E. Moore a sister of the intestate & Wm M. Kinningham & wife Louisa J. formerly Louisa J. Moore also a sister of the intestate - The intestate had a brother named Alexander who died some yrs before the intestate, leaving the following children his heirs at law, to wit Eliza, who intermarried with Deft. Said Wm Holland, & Elizabeth, Virginia, John, & Josephine Moore, who are entitled to 1/6 of the estate real & personal of the intestate, in right of their dec’d father said Alexander, said Virginia Moore is about 18 yrs of age, said John about 13 yrs of age & Josephine about 10 yrs of age - The intestate died seized & possessed of a valuable real estate, situate in Gibson Co. Tenn, of about 600 acres in 7th Civil Dist. Of said Co. on the waters of North fork of Forked Deer. The title papers to the same will be filed in this case, on or before the hearing, for more full & accurate description of the land, said land is principally bottom land, about 200 acres only being upland, the balance subject to over flow & valuable principally for its timber, & from the character & situation of the land, they believe its value would be materially impaired to divide it among the parties in interest, all the adult parties desire a sale of said land, as they live in a different part of the state & believe it would sell much better to cut it up, only into about 3 or 4 tracts, & they believe it is manifestly for the interests of the minor Defts & so state, to sell said land for division, rather than to divide it. They believe said land will sell for a fair price & not likely to bring much in value, for they are satisfied that their interests would be greatly prejudiced to cut up & divide said lands into lots among the parties in interest. Petitioner Louisa J. Kinningham states it is her purpose to have her interest in said estate settled upon her to her separate use. Premises considered Petitioners pray that the parties above named as Defts. Be made Defts. To the petition, that copy & spa issue as to said parties, directed vc. To the end that said Defts appear & answer this petition, that they fully answers make, that the spas be returnable to the April rules, that guardians ad Litem be appointed for said minors as they have no regular guardian, & that said land be sold for partition & for such relief as their case entitles them.
