PAYNE Will Gibson County September Term 1905 I , THOMAS H. PAYNE of the 21st District of Gibson County Tennessee being of sound mind and disposing memory and realizing that the date and hour of death is uncertain do now make and publish this my Last Will and Testament, hereby revoking all other wills by me at any time heretofore made. 1st Clause, It is my will that all my just debts be paid as soon after my death as practicable, if any I owe. 2nd Clause, It is my will that my wife shall take absolutely all my personal estate, not used in the payment of debts, including all except property of a personal nature. 3rd Clause, It is further my will and I hereby devise to my wife in trust for the use and benefit of herself and our children, all the real estate I may own at my death, the income of said real estate to be used for the purpose of my said wife and the support and education of my said children . This trust to continue as long as my said wife remains a widow and in event of her marriage again, then it is my will and I direct that a homestead such as is allowed by the laws of Tennessee be assigned her and the remainder of my real estate not covered by said homestead , be taken charge of by a guardian or trustee for my children, as for the last named position, I nominate my friend J.T. GORDON and the income from said remainder to be all used if necessary for the support and education of my said children. 4th Clause, I hereby nominate and appoint my wife ADA PEARL PAYNE as the Executrix of this my Will who will not be required to give any bond as such all erasures appearing in this paper were made before signing the same.
