These electronic pages cannot be reproduced in any format for profit or for other commercial presentation. ---------------------------------------------------------------- Guardian's Settlement Administrator's & Executor's Settlements 1859-1900 Grainger County, TN p. 96 I Jacob Beeler a citizen of Grainger County in the State of Tennessee do make and declare the following instrument of writing to be my last will and testament: herein making void and revoking all former wills by me at any time heretofore made and written I now herefore dispose of my worldly estate in the following manner to wit: 1st I will and direct that at my death my body may be decently buried in a becoming Christian like manner. 2nd I direct and will that all my just debts and funeral expenses be paid out of the first money that may come to the hands of my executors. 3d I will and bequeath to my beloved wife Nancy Beeler the following lands as herein described, to have and to hold use and occupy for and during her natural life, with the rents and issues thereof. Beginning on the south side of Flatt Creek on an ash tree Robert Justus and Pleasant Starnes corner in a line of six hundred and forty acre tract, granted to Anderson being part of the tract of land on which I now reside running north fifty two degrees east twenty one poles to a stake then south forty five degrees East three hundred and twenty poles to a marked line my south east boundary then south forty five degrees west with said marked line ninety poles to a stake then north forty five degrees west three hundred and sixty two poles to Robert Justices south east line then north forty five degrees east sixty nine poles to a rock corner then south fifteen degrees west forty four poles to the begining corner and supposed to contain about one hundred and ninety two acres. 4 I give and bequeath to my beloved wife Nancy Beeler the following personal property and effects to wit: All of my household and kitchen furniture except such as may be hereafter set apart to my son Robert B. Beeler, and my daughter Sarah E. Beeler. And I further give and bequeath to my said wife one large turning plow and also I will that she shall have the first choice of my horses I may die possessed of and first choice of all the milch cows and first choice of one yoke of oxen and ox cart and all the poltry on hand at my death of every kind and one thousand pounds of pork or bacon and all the lard that may be on hand and three hundred bushels of corn, seventy five bushels of wheat, and also the one half of my sheep that may be on hand at my death and eight of my first choice stock hogs. And I also will that my said wife, shall at my death have all the cotton, flax, wool, molasses and sugar that may be on hand at my death including soap soap greece and honey and all my bee stands and plenty of roughness to feed her stock for one year from my death and I further will and bequeath to my said wife Nancy one hundred dollars in cash to be paid over to her by my executor. I now will devise and bequeath to my daughter Sarah E. Beeler the follwing described parcel of land, it being the north east portion of the land I now live on: Beginning on a locust my north east corner running south fifty two degrees west one hundred and twenty one poles to a rock in the corner of my apple orchard then south forty five degrees east three hundred and twenty poles to my south east marked boundary line, then north forty five degrees east one hundred and twenty one poles to a rock corner in David Lodgeswoods line then north firty five degrees west to the beginning containing two hundred and forty two acres more or less. And she is to have immediate possesion of all of said parcel of land at my death except that portion of it devised to my wife Nancy for life, and at the death of my said wife, she is then to have absolute possession of all of said parcel of of land in fee simple. And I also will and bequeath to my said daughter Sarah E. Beeler one bed and stead and necessary clothing such as have been given to my other children who have married and left us and my wife being the judge as to the outfit. Also one cow and calf that may be selected by said Sarah E. out of my cattle when her mother has received hers, and two head of sheep one side saddle And I give, will and bequeath to my son Robert B. Beeler the following tract or parcel of land Beginning on Sarah E. Beelers north west rock corner in the edge of my apple orchard running north fifty two degrees east ten poles to an ash on the east side of a branch Robert Justices corner then north fifteen degrees west forty two poles to a rock corner Robert Justices south east corner then south fifty degrees west one hundred and twenty six poles to a rock Robert Justices south west corner then south fifty degrees east forty two poles to a stake then south fifty two degrees west sisty one poles to Samuel Johnson north east rock corner then south forty five degrees east three hundred and twenty poles to a rock corner then north seventy five dgrees east with a marked line eighty two poles to a chestnut oak corner then south forty five east to a rock a south west corner of a four hundred acre tract that Isaac Anderson deeded to Joseph Beeler, then north forty five degrees east seventy nine poles to Sarah E. Beelers south west corner then north forty five west with said Sarah E. Beelers line to the beginning and the said Robert B. Beeler is to have immediate possession and control of said described land at my death except that portion of the same willed to my wife Nancey Beeler for life but at her death to have full and complete possession of all in fee simple supposed to contain three hundred and forty eight acres more or less. And I also will and bequeath to my son Robert B. Beeler one mare and sorral colt mare callet Pet one saddle and bridle and saddle blanket one milch cow and calf and one open saw second choice of my stock hogs and two head of sheep one bed and bedstead and necccessary bed clothing such as is herin bequeathed to his sister Sarah E. Beeler and to be adjudged to him by my wife Nancy. And I will give and bequeath to my daughter Louisa Willis formerly Louisa Beeler, the following described lands to wit: Beginning on a rock corner near a Black in the center of Flat creek Valley road it being a corner between my land and the Cleveland heirs then north east twelve and one half poles to a rock corner in the center of said road then north east forty two poles to another rock corner in the center of said road Eli Clevelands south east corner then north forty five degrees west with a dividing line between myself and Eli Cleveland to a rock corner in a thousand acre grant survey granted to Joseph Beard Eli Clevelands north east corner then north forty five degrees east with the line of said thousand acre survey to a rock corner between myself and Isaac Beeler then south on a marked line to a poplar corner of a twelve hundrend and eighty acre survey granted to Maberry then south forty five west twenty eight poles to a chestnut then south forty five east twenty eight poles to a rock corner then south forty five east crossing clinch mountain to Nicholasons survey line so then south forty five west with the Nicholson survey line so for that a line north forty five west will strike the beginning corner then north forty five west to the beginning corner in the center of the Flat creek valley road and the said Louisa is to have and to hold the same in fee simple from the day of my death about four hundred and twelve acres. And I will and bequeath to my daughter Malissa Watson formerly Malissa Beeler the following described parcel of land Beginning on a rock corner near a Black oak Louisa Willis' beginning corner turning south forty five degrees east crossing clinch mountain to Nicholsons big ....line then south forty five degrees west so far then a line north forty five degrees west will Strike Daniel Haynes and John Nancyes south west corner of their farm known as the Chandler farm then north forty five degrees west to the south west corner of John Nances and Daniel Haynes frarm then north forty five degreed east with their line to the south east corner of their farm then north forty five degrees west to the rock corner in the valley road; it being the beginning corner between myself and teh Cleveland heirs then north fifty nine degrees east eighty one poles to a rock corner in the center of said road, then north seventy one degrees east senventy one poles to a stake in the center of said road opposite a large white oak then north sixty six degrees east thirty poles to the beginning in the center of said road opposite a black oak containing six hundred and eighty acres more or less And I will and bequeath the said tract or parcel of land to my said daughter during her natural life and if she should die leaving lawful bodily hiers then the same is to be inherited by them, but should she the said Malissa Watson die without such bodily issue surviving her then the same is to ...in my sons and daughters and their children surviving such as may be dead at the time of the death of my said daughter Malissa. And I will and bequeath to my said daughter one side saddle equal in value to the one given to my daughter Sarah E. Beeler. I will and bequeath to my son Joseph C. Beeler and Robert B. Beeler my surveying compass and instruments. And all the rest and residue of my estate not herein disposed of by this my last will and testament I give and bequeath to Joseph C. Beeler David Beeler Robert B. Beeler Mary M. Hill formerly Mary M. Beeler Louisa Willis formerly Louisa Beeler Sarah E. Beeler and Malissa Beeler; by first selling the same after legal notice to the highest bidder on a credit of twelve months my executor requiring notes and good security and the proceeds equally divided between my said named children. And those of my children last named which includes all of them some of them have already received all sintured them to have except their part of the residue of my estate above directed to be sold and divided accruing them all And I now nominate constitute and appoint J.C. Beeler and Robert B. Beeler Executors of this my last will and testament In testimony whereof I now request P.M Seuter and John P. Bowen to witness this my last will and testament and have here signed and do acknowledge the same in their presence to by my last will and testament this 2d day of October 1875. And my said last will is written on these eight pages of fools cap paper.
