Obediah named his wife as "Elizabeth". We believe Catherine was the daughter of John Fann & Margaret Unknown. John and Margaret Fann are first found in Greene Co., TN in 1783 on the Tax List. Many Fann children were married in Greene County, some of them migrated to other states to raise their families and died there. John Fann died before 1791 in Greene Co., TN, when his land was ordered to be sold. No children are named in court action to make his wife Margaret executrix of his property. 1790; No Census-for Greene Co., TN taken/found: 1795; Catherine Fann was a plaintiff in a court case in Greene County, TN, 1795. GREENE COUNTY, TENNESSEE; MINUTES OF THE COURT OF COMMON PLEAS 1783-1795; November Term 1795; James Hise enters into Bond with Jacob Hise and John Bird, his securities, in the sum of 200 dollars for the maintenance of Bastard Child born of Catherine Fann being charged on oath to be the reputed father. **No record if the child is male or female- if the child lived or died- or who the child lived with. 1797; Marriage--Greene Co., TN- 3 July 1797-Obediah McBee to Catherine Fann; FHC Film #944386 Tennessee, Greene County Vital Records, Marriages 1780-1855 1797; Tax List-Greene Co., TN:--no land--1 white Poll--no black Poll. – There is also an "Israel McBee" listed on the same Tax List with Obediah McBee- relationship if any is unknown? 1800; Not Found:--Whereabouts unknown. 1812; War of 1812---Possibly enlisted from Montgomery Co., TN; Obediah McBee served as a Private, in the War of 1812. Source: "Tennesseans in the War of 1812: Shown as OBADIAH MCBAY (MABBY), Pvt. Col. Philip Pipkin, Capt. John Strother, Inf" . ** He served from June 1814 to December 1814- 1st Regiment of the West Tennessee Militia- under Capt. Sands in Capt. John Strother's Company of Infantry- He deserted 20 September 1814- from Mobile; He is given a warrant dated 8 March 1815, as to his service and entitlement to his pay for the 6 months of service, signed by, "J. Winchester/Winchister, B.G.- US Army, from Ft. Charlotte, Mobile". I cannot read the name of the Capt. that signed the warrant (may be J.L. Sands?). Obediah's name is spelled several different ways on the 1812 Service Records that I received; 1.Obediah McBay, 2. Obadiah Magby, 3. Obadiah McBay. He signed a Power of Attorney to the Offices of McClure & Elder in Montgomery Co., TN, to seek and collect his pay for the 6 months of service in the US Military, He signed the POA as "Obediah McBay", and affixed it with his (seal) on 7 December 1815, it is Notarized by Stephan Thomas, J.P. of Montgomery Co., TN. I would think since he claimed payment in Montgomery Co., TN that he probably enlisted for service in the War of 1812, from Montgomery Co., TN- but I have no documentation to prove that. **As an Aside—in the year 2005, 190 years after Obediah McBee and family were in Montgomery Co., TN, a 6th Great Grandson was born in Clarksville the County Seat of Montgomery County—and "not knowing of the Scottish heritage", he was named "McKenzie", and being my first great grandchild it was an exciting event to say the least! **EFW. 1819; Perry Co., TN, we find Obediah and Family, he was one of the petitioners to the State to lay out the new county of Perry Co.,TN. 1820; Obediah is found on his first and only Census with his Family: 1820; Federal Census of Perry County, TN #149-Obeddiah Magby; Males-100101 Females-22101 They may be as shown below? 1-male up to 10 yrs--------------1810 to 1819;-------(Son ?) 1-male 16-26 yrs------------------1794 to 1804;-----William H. McBee (?) 1-male 45 yrs and Up-------------(?) to 1775;--------Obediah McBee (?) 2-females-10 yrs and Under-----1810 to 1819;---------Masie & Clarissa (?) 2-females-10-16 yrs--------------1804 to 1810;---------Hannah & Catherine (?) 1-female-16-26 yrs------ 1794 to 1804;-------- 1st Wife of William H McBee’s or possible older illegitimate ?daughter of Catherine (Fann) McBee;(?) 1-female-45 yrs and Up;----(?) to 1775;--1st Wife-Catherine (Fann) Or 2nd Wife Elizabeth Unkn? 1821; Obediah and son William H McBee are listed as Chain Carriers for Survey of 500 acres for "Robert Walker", Survey Bk #1, Page 23, in Perry Co., TN: Surveyor- George (?Peery/Purg?). 1827; Obediah and Family are not seen again until 1827 when his "Nun cupative Will" was recorded 27 January 1827 in Hardeman Co., TN. It appears he died in November 1826. There is no Real property passed and No descendants are named in the Will- except his wife who is listed as Elizabeth she received his Personal Property. It appears that Catherine had died and he remarried, we have no documentation of who this Elizabeth is or if it is "Catherine using a middle name, a nickname or a term of endearment. The Will is witnessed by William H. McBee and Barney Chambers—(we have no information or relationship if any, for Barney Chambers). November 1826-Obediah McBee died-Hardeman Co., TN; January 1827; "Nun cupative Will" Last Will and Testament Recorded-Hardeman Co., TN; ( Will ) listed in "Extracts of Hardeman Co.," (WILLS - ESTATE SETTLEMENTS AND GUARDIAN BONDS), BY (FAYE TENNYSON DAVIDSON & FAE JACOBS OWENS) COMPILED BY R. HAROLD COX, 1993. for Hardeman Co., TN" Book 1, page 34. The *** (Nuncupative Will) listed for an "Obediah McBee", (His Wife was Elizabeth) witnessed by a Barney Chambers and William H McBee: Put into writing next day after he died, which appears to have been 8/9 November 1826 and not recorded until, 27 January 1827. *** NUNCUPATIVE=oral will with witnesses. ************************* Obediah McBee's Nuncupative Will: State of Tennessee] Hardeman County] Obadiah is decest the 8th day of November (----?--) Rickmend my Boddy to its mother dust, and then my (soul?) to god. I give in bequeath to my wife Elizabeth all my property (hark?) cattle, hoggs, sheap and (bow ?) (s?) (ameition?) (& C?) and my farm and crops and rifle and one cart and what debts is due me and she (has?) the management of it to do just as she please with as (long?) as she lives and then she may distribut it to ares (heirs-EFW) as she thinks proper. This the 9th day of (March?) 1826. We Barney Chambers and William H McBee testify that we were present when Obediah McBee the above last request a nuncupative Will, and we now specially requested and called to be witness thereto by the said testator himself. and (?) the same was made in his own (directing ?) home in last sickness and that the above contains a true (Account?) of the said Obidiah request and Will relative disposition of the property, after his death and the same was put in writing next day after the (said?) Recorded, Jauy 27th 1827 Recorded as written, with original spelling and punctuation retained; by Elnora Frances Cook-Wyrick. **************************************************** Presumed Children of Obediah & Catherine (Fann) McBee; William H McBee-1798/1802--?TN-- to 1852-Van Zandt Co., TX; **We believe the "H" may stand for "Haywood", his great- grandson was named— " William Haywood McBee". William H. McBee married Wife #1 Name Unknown in (? TN). Using the naming pattern often used in that time period we consider both the names "Garvin & Newton" as two high possibilities for His first wife's maiden name. Wm. H. named his first son "John Garvin" and his 2nd son "William Newton", and William H.'s oldest daughter Rebecca (McBee) Karber Roberts named her 2nd son, "Jasper Newton" Karber. William H. McBee's second wife was Elizabeth Adaline Corgan-in TX; There are marriage license/bonds for 4 McBee Women in Hardeman Co., TN and due to the number of females listed on the 1820 census, we are claiming them as Obediah & Catherine (Fann) McBee's daughters. They are; Hannah McBee-1802/04-?TN--m. 26 Feb 1825, William Copeland- Hardeman Co., TN; Catherine McBee---1804/09-?TN--m. 26 Feb 1827, William Taggart-Hardeman Co., TN; Masie McBee--1804/09-?TN--m. 30 March 1827, Green B. Stokes-Hardeman Co., TN; Clarissa McBee-1810/20-?TN-m. 30 August 1837, Johnson Wortham-Hardeman Co.,TN; ****************************** There is a male and a female listed on the 1820 Perry Co., Census that are not accounted for- their names and whereabouts are unknown. I have not found proof such as deeds, wills, bonds or other documentation connecting our "Obediah McBee" to any of the other McBee Families living anywhere near him and his family.
