Payne from the Civil War. General Affidavit State of Arkansas, County of Washington: In the matter of James O. Payne late of Co K, 13 Regt Tenn Cav Vol. On this 17th day of March, A.D. 1899, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths, William L. Payne aged 61 years, a resident of near Fayetteville, in the County of Washington and State of Arkansas whose Post Office address is Fayetteville, Ark. I am a Brother of claimant and was a member of Co K, 13th Tenn Cav Vol and served with him in said Co & Regt and messed with him and know of my personal knowledge that the claimant did on or about Feb or March 1865 in VA about Wytheville contract Rheumatism in his legs. He was so debilitated from the said rheumatism that he could not walk without help and Lee Russell of our Co and I, had to support and help him off and on his horse and had to support him in walking as he was unable to walk by himself. From Wytheville we went to Salsberry (Salisbury, N.C.?) and at Salsberry he got so bad that he was sent to Knoxville but don't think he went to hospital. I had an opportunity of Seeing him frequently since discharge up to the last 15 years and all the time that I had an opportunity of seeing him he was badly afflicted with said disease. and by reason thereof he could not perform more than 1/3 manual labor. Said Russell was killed near Salsberry. I further declare that I have no interest in said case and am not concerned in its prosecution. William L. Payne Declaration For Pension State of North Carolina, County of Madison On this 2 day of December, A.D. one thousand nine hundred and ten, personally appeared before me, a justice of the peace within and for the county and State aforesaid, James O. Payne, who, being duly sworn according to law, declares that he 75 years of age, and a resident of Allanstand, county of Madison, State of North Carolina; and that he is the identical person who was Enrolled at _______ under the name of James O. Payne, on the 22 day of September, 1863 as a private, in (Co.) K 13th Tenn Cavalry in the service of the United States, in the Civil War, and was Honorably Discharged at Knoxville Tenn., on the 5" day of September, 1865. That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follows: Height, 5 feet 10 inches; complexion, fair; color of eyes, blue; color of hair, light; that his occupation was ______; that he was born November 5, 1835 at Mecklenburg, N. C. That his several places of residence since leaving the service have been as follows: Greene Co. Tenn 1873 Madison Co. N. C. since about 1881 That he is a pensioner. That he has heretofore applied for pension ctf. 571471 Rate $15.00. That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the act of February 6, 1907. That his post-office address is Allanstand, county of Madison, State of North Carolina. James O. Payne Attest: (1) D. E. Shelton (2) Polly Gosnell Also personally appeared D E Shelton, residing in Madison Co and Polly Gosnell, residing in Madison Co., persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw James O. Payne, the claimant, sign his name to the foregoing declaration; that they have every reason to believe, from the appearance of the claimant and their acquaintance with him of 20 years and 10 years, respectively, that he is the identical person he represents himself to be, and that they have no interest in the prosecution of this claim. A. G. Shelton Justice of the Peace General Affidavit State of Tennessee, County of Greene: In the matter of Louisa Payne widow of James O. Payne. On this 13 day of July, A.D. 1915, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths William Dickson aged 89 years, a resident of Paint Creek in the County of Greene and State of Tennessee whose post-office address is Greeneville R.F.D. no. 12 well known to me to be reputable and entitled to credit, and who, being duly sworn, declares in relation to the aforesaid case as follows: That I have known the pensioner James O. Payne since the year 1846, which was 12 years before his marriage to the claimant whose maiden name was Louisa Fowler and that he was never married before he married the said claimant. I also knew the said claimant about 12 months before her marriage to said soldier and that she was never married before she married the said soldier. And that the said soldier and claimant have lived continuously as man and wife ever since their marriage in 1858. And that neither have been separated nor divorced from said marriage . And that the said soldier died on July 6th, 1915. All the forgoing knowledge is gained by me living in near distance of them where I could see them several times during the year. Further states that I knew the claimant's mother Mrs. Fowler, but cannot just now call her given name and that she and said claimant moved to this county from S.C. about a year before the marriage of claimant to soldier. William Dickson
