IN 1831, JOHN KERBAUGH PETITIONED THE GREENE COUNTY COURTS TO PARTITION HIS FATHER'S ESTATE. IT IS ASSUMED THAT GEORGE'S WIFE, KATHERINE (LINGENFELTER) KERBAUGH HAD DIED BY SEPTEMBER 11, 1830. THE COURT PETITION NAMES ALL HEIRS OF GEORGE KERBAUGH, HENCE PROVIDES US WITH A "PROVEN" RECORD OF THE CHILDREN OF GEORGE AND KATHERINE LINGENFELTER KERBAUGH. THE FOLLOWING IS TRANSCRIBED FROM THE GREENE COUNTY, TN, COURT MINUTES. SPELLINGS AND PUNCTUATIONS ARE UNCHANGED. NOTICE THE SPELLING VARIATION OF THE KERBAUGH SURNAME AS "KERBOUGH". THE CHILDREN MARKED WITH AN ASTERISK (*) WERE MARRIED IN GREENE COUNTY. ALSO, ONE OF THE DAUGHTERS, CATY, AND HER SPOUSE, JOHN MYERS, MARRIED IN GREENE COUNTY HAVE DIED BEFORE HER FATHER, GEORGE, IN 1831. _______________________________________________________________________ Greene County, Tennessee Court Minutes "28 April 1831 The Petition of John Kerbough was presented, setting forth that his father George Kerbough died intestate seized and possessed one hundred and fifty acres of Land in Greene County, which has not yet been divided that the heirs of said Intestate are the petitioner, Christian Kerbough, Elizabeth Slusser formerly Elizabeth Kerbough, Jacob Apply and wife Eve formerly Eve Kerbough, Frederick Myers and Wife *Polly Myers, Jacob Trobough and Wife *Nancy, Daniel Farner and Wife *Sally, Polly and Eliza Myers Heirs of *John Myers Decd, Daniel, *Jacob and *George Kerbough, James Vance and Wife Margaret formerly Margaret Kerbough, That he has bought the shares of Frederick Myers and James Vance in said Estate and praying that said Land may be divided and his shares laid off and it appearing to the Court, from the newspaper printed at Jonesborough called "Farmers Journal" of the 11th 18th and 24th September and 3rd October, 1830, that the Petitioner has given legal notice of his intention in presenting his petition, to all the heirs aforesaid, except James Vance and Wife, to whom he has given written notice as appears from the evidence of George Smelcer and no opposition being made to said petition, It is therefore ordered that James Patterson Surveyer with Christian Dyche Esqr, John Hull Jr., Marshall Hartman and Adam Proffit be, and they are hereby appointed a Jury to divide and lay off to the said John Kerbough his three shares as aforesaid in said one hundred and fifty acres of land, according to law, and to report their proceedings, and appropriation to our next Court. John Balch Thomas Murphy D. Rankin" 29 April 1831 The Commissioners appointed at the last Court to allot and divide to John Kerbough three shares of the Lands of George Kerbough three shares of the Lands of no objection being made to the same, it is considered by the Court that said division and allotment be in all things affirmed and established agreeable to said report and that said report be recorded and admitted to registration. It is further ordered that the Jurors be allowed one Dollar each and the surveyor _?_ dollars, for their service in making said division and allotment.
