Hill } To: Deed } J. W. E. Moore } Filed Oct. 18, 1922 } At 4:30 O'clock P.M. } This indenture made and entered into on this the 18th day of October 1922, by and between MRS. EMMA K. HILL of Brownsville, Haywood County, Tenn. party of the first part, and J. W. E. MOORE also a resident of said town, County & State party of the Second part, Witnesseth: That I, MRS. EMMA K. HILL, widow, party of the first part, for a valuable consideration to me cash in hand paid, and the further consideration of the execution and delivery to me by said MOORE of his three promissory notes of even date, herewith each in the sum of FIVE HUNDRED DOLLARS and payable on the 15th day of Nov. of the years 1923, 1924 and 1925 respectively and each of said notes bearing interest at six per cent from date, I have this day bargained, sold, transferred and conveyed unto the said J. W. E. MOORE, party of the second part, his heirs and assigns forever, all of my right, title interest and estate in and to the following described two tracts of land, both being situated, lying and being in the 9th civil District of Haywood County, Tenn. and more particularly described as follows: First Tract: Bounded on the north by the NEBLETT tract, on the east by the lands of WILL DIXON, on the south by the land next described herein (SIMON WALKER) and on the west by the tract formerly owned by INEZ AUSTIN and containing 50 ACRES. 2nd Tract: Beginning at a stake in the north boundary line of the tract of land heretofore sold by D. O. THOMAS to SAM OUTLAW 12 feet west of the northwest corner of said tract, runs west with said north boundary line to a stake in the east boundary line of the tract of land bought by D. O. THOMAS of THOMAS Est., thence north with said line 170 feet to a stake, thence east to a stake 22 feet west of WM. DIXON'S west line, thence south to the beginning containing 45 acres. Said two tracts join and in fact constitute one tract of 95 acres and being the same tracts of land conveyed to me by WM. KINNEY trustee, by deed now of record in the Register's office of Haywood County, Tenn. in deed book No. 52 at page 356, and being the same land conveyed to SIM WALKER by D. O. THOMAS by deed of date NOVEMBER 27, 1903, and which deed is now of record in the Register's Office of Haywood County, Tenn. in deed book No. 30 at page 589 thereof. Said land was conveyed to me by the said WM. KINNEY, trustee, subject to two prior encumbrances or trust deeds; one to S. F. THOMAS, Trustee to secure the payment of $507.45 as is shown by trust deed in trust deed book No. 4 at page 285 thereof and also another trust deed to N. A. TAMM, trustee made to secure the payment of a certain indebtedness of $371.00 to L. E. TAMM, as appears of record in trust deed book No. 4, age page 286, therefore (said two prior encumbrances and notes being my property and there was also a trust deed on said land to AARON STERNBERGER, trustee made to secure the payment of $464.56 and payable to the legal holder as appears by trust deed now of record in the Register's Office of Haywood County, Tenn. in Trust deed book No. 12 at page 177 thereof, and said last mentioned encumbrance and note were also my property). I have this day marked each and all of the said notes paid in full and have released each and all of said trust deeds as now appears of record in said Register's Office in said respective trust deed books and at the respective pages heretofore mentioned and I here declare that I am the legal holder of said encumbrances trust deeds and notes which have been paid in full and which I have released of record by marginal release as aforementioned and marked Exhibits "A", "B" and "C" respectively. To have and to hold said land unto the said MOORE, party of the second part, his heirs and assigns, forever. I covenant with the said MOORE that I am lawfully seized and possessed of said land in fee simple and that same is unencumbered and I further covenant with the said MOORE, party of the second part, that I will forever warrant and defend the title to said land, against the lawful claims of any and all persons whomsoever. DAVIS, Clerk of the County Court of said County, EMMA K. HILL, widow, the within named bargainor, with whom I am personally acquainted and who acknowledged that she executed the within instrument for the purposes therein contained. Witness, W. T.
