LAMBERT We are authorized to announce John ASHE,Esq.,of Brownsville,as Republic Whig Candidate,to represent the Senatorial District,composing the counties of Madison,Haywood,Tipton and Lauderdale,in the next Legislature. Thomas H.BENTON has been re-elected to the Senate of the United States,for the term of six years,from the 4th of March next,by the Legislature of Missouri. We learn from the Nashville papers,that the Governor-elect of Illinois,Mr.CARLIN,died at Peoris,a few days since.The duties of the office devolve upom Mr.ANDERSON,of the Lieutenant Governor. ( From the Nashville Whig of Dec.5 )--FATAL AFFRAY AT COLUMBIA. Intelligence reached this city yesterday of the death of Richard H.HAYES,Esq.,of this city,in a street encounter in Columbia with Mr.William POLK,of Maury,brother of the Hon.James K. POLK.The parties met on the Public Square about 4 p.m. Monday,each armed with pistols and exchanged shots almost simultaneously,a buckshot from POLK’s pistol piercing the brain of his ill-fated antagonist.HAYES lived through Monday. FOR SALE OR RENT--The subscriber is desirous to sell his Plantation,situated in Haywood County;four miles south of Brownsville,containing 400 acres of land,of which about 100 acres is cleared and under good fence.There is upon the tract,a comfortable Dwelling House,with other necessary out-houses and adjance to a fine spring of water.Terms made known by application to the subscriber in Brownsville. NIXON & Company,was dissolved by mutual consent on the 22nd day of June last; all persons who are indebted to said firm of J.H. CHANCERY SALE--By virtue of a decreetal order of the Chancery Court of the Western Division of the State of Tennessee,holden at Brownsville at its November Term,1838,made in the case of Samuel J.WILLIAMS Henry B.S. and Joseph WILLIAMS,complainant for division of the land--viz; Wm.B. GROVE, Guardian at litem of Wm.T.WILLIAMS, Giden J. WILLIAMS, Martha M.WILLIAMS and Elizabeth A.WILLIAMS,minors, I shall at the Courthouse,in the said town of Brownsville,on the 10th January 1839,proceed to sell to the highest bidder,the following tract of land,to wit: Lying and being in the counties of Tipton and Lauderdale,and State of Tennessee,on the Big Hatchie River,extending on both sides in the 11th Surveyors District;third and fourth Range, 8th and 9th Sections,being on the 6th part of a five thousand acre tract,granted to Daniel MALLETT; by Entry 1253,Grant No.276,beginning at a white oak marked H.S.W. and a slippery elm marked W.H.F.E.,situated on the east boundary line of said Grant No.276,and 330 poles from the North East corner of said grant,running thence West 290 poles to a stake,thence in a South Western direction to the slough below the ferry,thence South,so far by running East,the compliment will be included.--Terms of Sale-- One third of the purchase money is to be paid in six months;one third in twelve months,and the balance in two years. The above tract is inferior to none in the District,as regards to fertility,convience and health.It’s peculiar position secures it to every advantage desirable for an extensive cotton plantation,or stock farm,situated mostly on the North side of the River,running only a short distance across it.There are four hundred fifty to five hundred acres,first rate tillable land,lying most happily for cultivation,and upwards of one hundred acres cleared.As for residence,no place surpasses it in beauty,or has finer spring water.There is a cotton gin on the premises,and comfortable log homes,a good orchard,etc. Persons wishing to purchase would do well to examine for themselves. INFORMATION WANTED--Information wanted and asked at the hands of all the hands of all the editors in the United States,who are friends to their country.I,the widow of William McCAIN,dec’d.,who was a soldier of the revolution,and suffered much in the struggle for independence,desirous of proving my marriage,and procuring a pension from the United States,wish to gain information,respecting the residence of my relations,in order to establish the fact.Mt parents emigrated about the year 1785,from Orange County,N.Y.,to the Western States of Kentucky.My father’s name was Thomas JOHNSON,and my mother’s maiden name,Susan PARPINO; our family consisted of several children,my brothers names were John,Benjamin and George JOHNSON.Should any of them see this notice,they will writ and state where they are.Editors in the Union will please give this two or three insertions for the benefit of an indigent widow,who suffered much herself for freedom-- Charlotte McCAIN--Warwick, Orange County,N.Y. Nov.14th,1838. MATHEWS--James VENABLE. December 11,1838. MR. CHRISTIAN WINTERS of HAGERSTOWN,MD--accidently shot his own son,a boy seven or eight years old.A pistol in the hands of the father,which he was cleaning,accidently went off,the ball piercing the boy’s head. A TRIAL FOR MURDER--In the case of Peter POND,tried on Saturday in the Baltimore County Court,for the murder of his wife,jurors,without leaving their seats,returned verdict of “Not Guilty”. He was postivily insane. John B.ASHE, Clerk & Master The bill states that on the 13th day of June 1838,Timothy BRYAN, Jno.RODMAN and Isaac B.HOLDEN,obtained a judgement against complainants of $6464.92cts. with $1.62 1/2cts.cost,as the securities of Samuel GLASS,Sheriff of Tipton County,for the non-return of an execution in favor of BRYAN,HOLDEN and RODMAN,against VAUGHT,COWAN,and EMMERSON; alleges that complainants have paid the larger part of the judgement,that VAUGHT has left the State of Tennessee.leaving a large amounts of debts due him,accounts,notes,with the books of his mercantile concern,which are in the hands of his former clerks,and they are daily and hourly collecting the same;alledges that Joseph G.BOON, C.M.COWAN and John VASSER are also indebted to the defendant,VAUGHT,in large sums of money.That one of complainants,J.McKEE is indebted to VAUGHT $______(left blank).And the defendants, HAROLSON,EVANS and W.C.VAUGHT have in their hands,or possession,the books and papers,with money,notes,chose in action a.c. belonging to VAUGHT,and are daily collecting the same;Prays for attachment,attaching in the hands of the defendants,the books,notes,accounts,& C. of Dan VAUGHT and Supeona (there is a mark I can’t make in typing) Wm.M.GROVE December 4th,1838---3t--Pr’s fee $15.00. It appearing to the satisfaction of the Clerk & Master,by affidavit filed,that William J.HAMLET,one of the defendants,is not a resident of the State.It is ordered that publication be made in the District Herald,a newspaper published in Brownsville,for three successive weeks,commanding the said non-resident defendent to appear therein,on or before the next term of this Court,on the third Monday in May next,and plead answer or demurr to complainant’s bill,otherwise the same will be taken for confessed ans set down for hearing ex parte.John B.ASHE,C.& M. ALLEGATION OF BILL--The Bill states that the defendents,Wm.J.HAMLET,and Herny W.ANDERSON are partners in trade under the firm and style of--HAMLET & ANDERSON,of Bolivar,Tennessee are indebted to the complainants,John Richmond JAFFRAY,David BROWN and Robert JAFFARY,(note name didderence of David,but his initial in first listing is B.),merchants,trading anf the firm and style of Robert JAFFREY and Company,of New York,in the sum of thirteen hundred and fifty seven dollars and fifty eight cents,and that the defendents being so indebted in 1837,drew their Bill of Exchange for the above amount,on Caruthers,Harris & Company on the 20th of March 1837,which was not accepted.That said Bill was duly protested for non-acceptance,and that said HAMLET & ANDERSON notified of the same.That said Bill is still due and unpaid.That the firm of ANDERSON and HAMLET is dissolved.That HAMLET has absconded and left the State,and that ANDERSON had left the State and gone to parts unknown to Complainants.That Defendent Joseph M.RUTLEDGE was indebted to the firm of HAMLET & ANDERSON,by Bond in a large amount.That said RUTLEDGE executed to the said Henry W.ANDERSON,two notes of one thousand dollars each,and took up the note which was due the firm,which notes,the complainants charge to be property of the firm,and subject to equity to the payment of the partership debts.That said firm has no other partnership debt or property in State known to complainants.They pray that said debts of RUTLEDGE to said ANDERSON be attached in RUTLEDGE’s hands,and that all others be enjoined from paying the same to any other person,and that said RUTLEDGE be required to pay same over to Complainants---HENDERSON & CHALMERS; solicitors December 4th,1838--3t--Pres.Fee $15.00 NOTICE--To the Creditors of William JOHNSON,deceased.Suggestions having been made to the proper authority of the insolvency of the Estate of William JOHNSON,dec’d.,creditors thereof,are hereby notified to file their claims with the Clerk of the County Court of Haywood County,Tennessee,before the first day of March 1839. LAND FOR SALE--The subscriber wishes to dispose of that valuable tract of Land on which he now resides,containing 325 acres,together with the improvements thereon,consisting of a comfortable dwelling house and all the necessary out houses appertaining thereto.This land lies on the road leading from Brownsville to Ferguson’s Ferry,about 12 miles from the former place.Terms made known on applications to the subscriber; a bargain will be given. NOTICE--Those indebted to TAYLOR; MATHEWS,and VERABLE,are informed that their bonds and accounts are in the hands of Howell TAYLOR,and unless paid before the first of January next,will be placed in the hands of an officer for collection. December 4th,1838. NOTICE--All those having open accounts with us for 1836 and 1837,are hereby requested to come forward and close them by cash or note,forthwith--those that donot attend to this reasonable request,must expect to be dealt with in a more severe manner.We would further say that we are in debt,which debts we must pay,and to enable us to do so,we must make collections---We do fondly hope all those that are indebted to use will come forward and throw in their mite,and by doing so,enable us to carry on our business without the disagreeable necessity of pushing any one,which we will be compelled to do,indiscreminately,if we cannot otherwise collect. MUNFORD and Nat.POTTER DEFENDANTS On the motion of Complainant;and it appearing to the satisfaction of the Clerk & Master,by affidavit filed,that the defendant,Stephen DONALDSON,is a non-resident of this State;it is ordered that publication to be made in the District Herald,a newspaper published in the town of Brownsville,for three successive weeks,commanding the said S.DONALDSON to enter his appearance herein,at the next term of this Court,to be holden at the Court house in Brownsville on the third Monday in May next,and plead,answer,or demurr,to complainants bills,otherwise the same will be taken for confessed against him,and set down for hearing,ex-parte/ John B.ASHE,C.& M. THE BILL states that during the year 1837,complainant,with his deceased partner,were engaged in the mercantile business in Randolph,Tipton County.That during that year,they sold the defendent DONALDSON,goods and merchandise to the amount of $261.76cts.And on the first of January 1838,defendant DONALDSON executed his note for the above amount,and has since left the State,without paying the same,or any part thereof.Alleges that defendents MORTFORD and POTTER have in their possession monies and other effects of DONALDSON,which complainant is desirous to arrive at by attachment:Prays for an attachment of all monies,goods and chattles of DONALDSON in their hands,and for subpoena,&c.
