Brown, Robert White & Jacob Polk, Judges in presence of Counsel on both sides and whereas in obedience to the Decrees heretofore made on the Third day of October A. D. 1821 and also on the 28th day of August last. Henry Rutherford, William Harris, William G. B. Killingsworth & William L. Mitchell the Commissioners appointed to Divide and Divide the Lands in said Decree specified made the following __ bearing date the 27th March 1823 accompanied by a survey and plat in the words and figures following (to wit) In obedience to an order to us __ from the Honorable the Supreme Court of __ and __for the fourth Judicial Circuit at July Term for the year 1821 authorising us to make partition and Divide certain tracts of land between the heirs of JAMES TISDALE and the heirs of DANIEL WHEATON therefore the undersigned commissioners have agreeable to the above order laid off and allotted to the heirs of JAMES TISDALE the following tracts of land to wit GRANT NO. 401. Beginning at an Elm. ARCHIBALD MURPHREY'S South east corner runnin south seven Hundred and Forty six poles to two poplars and __the south west corner of Grant No. 408 north west corner of __Grant No. 411 thence west fourteen hundred & sixty six poles to a stake Thence north 746 poles to a stake thence east passing MURPHREYS corner and with his line fourteen hundred and sixty six poles to the beginning containing SIX THOUSAND SEVEN HUNDRED AND EIGHTY EIGHT ACRES. GRANT NO. 412. Beginning at a poplar the South west corner of Grant No. 411. The north west corner of Grant No. 403 and the south east corner of Grant 407 running south with the line of Grant No. 403. Seven hundred and forty two poles to a white oak & water oak thence west twelve hundred and fifty poles to a white oak and Iron wood thence North seventy two and a half degrees west four hundred and thirty eight poles to a oak BENJAMIN SMITH'S corner of Grant No. 409 thence north with the line of said Grant six hundred poles to a white oak corner of Grant No. 407, thence East with the line o the same sixteen hundred and seventy six poles to the beginning containing SEVEN THOUSAND SIX HUNDRED & SIX ACRES. Beginning at a poplar and hickory the south west corner of Grant No. 410, the north west corner of Grant No. 415 and the south East corner of Grant No. 400 running South with the line of Grant 415 six hundred and forty poles to a hickory thence west Twelve hundred and fifty poles to black gum, dogwood and Ironwood thence South six hundred and forty poles to a white oak and poplar the southwest corner of Grant No. 400 thence East with the line the same Twelve hundred and Fifty poles to the beginning containing FIVE THOUSAND ACRES. GRANT NO. 411. beginning at two poplars and ash the south west corner of Grant No. 402, the South east corner of Grant No. 401 and the north east corner of Grant No. 407 running thence South seven hundred and sixty two poles to a poplar thence East fourteen hundred and sixteen poles to a Dogwood and White oak, Thence North Seven Hundred and Sixty two poles to two Ironwood and White oak, the south East corner of Grant No. 402, Thence West with the line of said Grant Fourteen hundred and Sixty two poles to the beginning containing SIX THOUSAND NINE HUNDRED AND THIRTY-FOUR ACRES. We have also laid off and allotted to the heirs of the said DANIEL WHEATON the following tracts of land (to wit) GRANT NO. 407. Beginning at two poplar and ash the South west corner of Grant No. 402 the south west corner of Grant No. 411 and the South East corner of Grant No. 401. Running South with the line of Grant 411 Seven hundred and fifty two poles to a poplar thence west sixteen hundred and twenty six poles to a white oak the north west corner of Grant No. 412, thence north seven hundred and sixty five poles to a white oak and ironwood thence East sixteen hundred and seventy six poles to the beginning containing SEVEN THOUSAND AND TWO HUNDRED & EIGHTY TWO ACRES. Beginning at a water oak and white oak the South west corner of Grant No. 403 and South East corner of Grant No. 412 running South Seven hundred and forty two poles to a hickory and dogwood thence west twelve hundred and fifty poles to a dogwood and Black Gum the North west corner of Grant No. 400, thence south seven hundred and forty two poles to a white oak and ironwood. thence East twelve hundred and fifty two poles to the beginning containing FIVE THOUSAND SEVEN HUNDRED AND NINETY SIX ACRES. GRANT NO. 400. beginning at a hickory and dogwood, the North west corner of Grant No. 410 and the south east corner of Grant No. 403 running thence south seven hundred and ninety poles to a hickory and poplar thence west twelve hundred and fifty poles to a poplar and white oak the north west corner of Grant No. 414, thence North seven hundred and nineteen poles to a black gum and dogwood the south west corner of Grant No. 413, thence East twelve hundred and fifty poles to the beginning containing FIVE THOUSAND SIX HUNDRED AND SEVENTEEN ACRES. GRANT NO. 402. beginning at an Elm. ARCHIBALD MURPHREY'S south east corner And the Southwest corner of Grant No. 416 in the name of BENJAMIN SMITH, running thence south seven hundred and forty six poles to two poplars and an ash the North west corner of Grant No. 411, the North East corner of Grant No. 407 and the South East corner of Grant No. 401, thence East fourteen hundred and fifty poles to a stake thence north seven hundred and forty six poles to an __thence west fourteen hundred and fifty poles to the beginning containing SIX THOUSAND SEVEN HUNDRED AND SIXTY ONE ACRES. GRANT NO. 403. Beginning at a poplar the South west corner of Grant No. 411, the South east corner of 407 and the North east corner of Grant No. 412, running thence south seven hundred and forty two poles to a Water Oak and White Oak, JOHN BROWN'S north west corner, thence east with the line of said BROWN, passing his corner in all fourteen hundred and sixty two poles to a stake in DAVID SHELTON'S (sp?) line, thence north seven hundred and forty two poles to a dogwood and white oak thence west fourteen hundred and sixty two poles to the beginning, containing SIX THOUSAND SEVEN HUNDRED AND EIGHTY ACRES. PART OF GRANT NO. 410. Beginning at a hickory and dogwood the South East corner of Grant No. 413 and the north east corner of Grant 400, running thence South seven hundred and nineteen poles to a hickory and poplar the South east corner of Grant No. 400, the north east corner of Grant 414 and the north west corner of Grant No. 415, thence East six hundred and twenty poles to a stake on the line of said Grant No. 415, thence north seven hundred and nineteen poles to a stake in the JOHN BROWN line thence west six hundred and twenty poles to the beginning, containing TWO THOUSAND SEVEN HUNDRED AND EIGHTY SIX ACRES. Also TWO HUNDRED AND FIFTY ACRES in the south west corner of Grant No. 401, beginning at the north west corner of Grant No. 407 running east two hundred and ten poles to a stake thence west eighty poles to a stake thence south ninety poles to a stake thence west one hundred and thirty poles to a stake thence south to the beginning which is claimed by Grant No. 379 in the name of DAVID CRAFORD (sp?) appears in the __ & plan. Also to the heirs of said JAMES TISDALE TWO HUNDRED FIFTY ACRES in the north west corner of Grant No. 401. Beginning at the northwest corner of a TWO HUNDRED AND FIFTY ACRE trail as laid off to the heirs of DANIEL WHEATON in the sough west corner of said Grant No. 401 running thence East eighty poles to a stake, thence north five hundred poles to a stake thence west eighty poles to a stake thence south five hundred poles to the beginning which is also claimed by Grant No. 379 in the name of DAVID CRAWFORD as appears by the annexed plan.
