Raterree Last Will & Testament I, James E. Raterree do make and publish this as my last will & testament, hereby revoking & making void all other wills by me at anytime made. First I direct that my funeral expenses & all my debts be paid as soon after my death as possible, out of any money, that I may die possessed of, or may first come into the hands' of my executor. Second I give & bequeath to my wife Mary Ann Raterree my home tract of land including the adjoining tracts known as the Wilson tract or the Schoolhouse tract, including & excluding that part sold off for school purposes. All of said tracts containing Three Hundred & fifty acres more or less to have & hold the same during her lifetime or widowhood. In case of her death or marriage, said lands to go to my daughter Elizabeth Raterree. The above lands bounded on the East by D.T. Bouier (sp), North by W.G. Thompson heirs & Elizabeth Alexander & Bucy heirs, West by J.M. Groom(sp), South by Asa Raterree, E.L. Wynn & the D.C. Steel tract. I also give my wife Mary Ann the following personal property, to have & to hold the same during her lifetime & at her death if not otherwise disposed of by her to be equally divided between my children. vir. Two choice horses or mules, one buggy & harness, Two choice cows & calves, Hogs enough to ma.ke her meat for one year & a sufficient amount of stock hogs for the second year, all the household & kitchen furniture, except the organ, which I give to my daughter Dora Raterree, also excepting our bedstead bed and bed clothing for each of my three daughters, Dora, Annah & Elizabeth Raterree. I also give & bequeath to my wife Mary Ann, one choice yoke of oxen & wagon, Two plows & gear & one double shovel plow & enough corn & hay to feed all stock one year. I also give my wife Mary Ann my Dividen in Bank of Henry at Paris Tennessee, as it may be declaired from time to time to use the same for the benefit of herself & my four children, James W. Dora, Annah, & Elizabeth Raterree during her widowhood and provided she should marry the same to be used equally for the benefit of the above named children until they become twenty one years of age but is to go into the hands of a guardian, after which such child can draw his or her share of said dividend & use as they see proper. Thirdly. I give & bequeath to my daughter Nettie Oliver & her bodily heirs, the following tract of land, situated on Tennessee River in Calloway Co.,Ky. Known as a part of the John Elkins tract. Beginning on the river at the S.E. corner of Asa C. Raterree tract at a Hackberry with Aok, .Hackberry & Elm pointers, running West with Asa C. Raterree, Nick Folkes (sp) & Ed Acres lines cornering on a Black oak, thence South with L.P. Moodys line to a corner in said line West of the Roberts house. Thence East to a corner on Tennessee River with Hickory & Birch pointers. Thence North with the meanderings of the river to the beginning. Containing Three Hundred acres more or less. Fourth. I give & bequeath to my daughter Annah Raterree & her bodily heirs a part of the said Elkins tract of land. Beginning at a Birch corner on the River, being the S.E. corner of the above discribed tract (given to my (daughter Nettie) and running West with said line to the corner of same on L.P. Moodys line, Thence South with L.P. Moodys line to James A. Patterson N.W. corner & my S.W. corner, Thence E with James A. Patterson & Asa Raterrees line to a rock corner on the River, Thence North with the meanderings of the river to the beginning. Containing Three Hundred acres more or less. As the land discribed tract of land is not valued by me to be worth as much as the one I gave my daughter Nettie, I also give to my daughter Annah the sum of Five Hundred dollars in cash to be controled as may hereafter be directed. I also give my daughter Annah one horse bridle & saddle, 1 cow & 1 sow or the value thereof in money. Fifth. I give to my daughter Dora Raterree & her bodily heirs a part of the Mouth of Sandy tract of land. Beginning at A.J. Weldons S.E. Corner on the Tenn. River running West with A.J. Weldons line to the N.W. corner of the Mouth of Sandy tract, Thence South, to a stake in the West line of said tract about 20 yards North of the Paris road near P.S. Nancis barn on said road, Thence E to the Tenn. River Birch corner with Birch pointers. Thence North with the meanderings of the river to the beginning. Containing Two Hundred & Fifty acres more or less. I also give to my daughter Dora one horse bridle & saddle I cow & 1 sow or the value thereof in money. Sixth. I give to my son James W. Raterree the remainder of the Mouth of Sandy tract of land, lying South of above discribed land (given to my daughter Dora) I also give to my son Jas. W. Raterree Five Hundred dollars in cash, also one horse bridle & saddle or the value thereof in money - also Igive to my son James W. Raterree one acre of land lying on the East bank of Tenn. River in Stewart Co. and the N.W. corner of the James Campbell tract J of land, bounded on the North by A.J. Gray. East by Henry McGee, West by Tenn. River, South by Henry McGee Seventh. I also will & bequeath to my daughter Elizabeth Raterree the Steel & Wynn tracts of land joining my home tract of land on the South. Bounded on the West by Wm Wynn, South by Lige Moody, East by Winchester, containing Two Hundred & forty acres more or. less, also Three Hundred dollars in cash also one horse bridle & saddle. 1 cow 1 sow. or the value thereof in money. Eighth. I give to Clinton Gipson, provided he remains with me or my widow til he is twenty one years of age, one horse bridle & saddle - one hundred dollars in cash Ninth. I also request that the tract of land known as the Brown tract & owned by me being situated in the state of Ky. & county of Calaway, lying on Tenn. River & bounded 6n E by Tenn. River N. by widow Brown & Hodge West by Joe Rowlett, South by Asa C. Raterree containing five hundred & ninety six acres, more or less to still be rented out after the present contract expires until my daughter Elizabeth Raterree becomes twenty one years of age, then to be equally divided between Asa C. Raterree, to have first choice, my daughters Nettie Oliver, Jas. W. Dora, Annah & Elizabeth Raterree. I want all my effects both personal & real not otherwise disposed of to be sold & collected by my executor except my Bank stock, which I want equally divided between all my children as soon as the youngest arrives. at the age of twenty one years. I also want the proceeds of the above personal & real effects to be equally divided between all my children after paying all debts. Providing any of my children should die & leave no bodily heirs, that part of my estate bequeathed to such child shall be equally herein by the other children. I desire that a guardian be appointed for such of my children as shall be under the age of twenty one who shall manage & control all property left to my children by me & not otherwise disposed of. County Thursday June 27,1895 This day came Mrs. Mary Ann Ratteree of (SP) troduced exhibited to the court a paper or instrument in writing purporting to be the last will & testament of James E. Ratteree did(sp) proposed the same for probate. Thompson came J.M. Thompson & J.A. Washburn, subscribing witnesses There to who being duly sworn in open court diposed & sat that they were acquainted with the said Jas. E. in his lifetime that they saw him sign this and him publish & declair the said paper or instrument in writing to be his last will & testament, that they signed the same as witnesses in his presence & at his request & that he was at the time of sound disposing mind & memory. It is therefore ordered by the court that the said paper or instrument in writing be & the same is hereby admitted to probate as the last will & testament of the said James E. Ratteree deed. that the same be so certified & recorded. Allest James S. Aden County Court Clerk * James E.
