James Draper vs. Parthena Jones Mary Loftis James Jones Thomas Jones Laborne Loftis William Jones Rebecca Jones George Jones Anderson Jones Elizabeth Jones & Alexander Jones Be it remembered that on the 15th day of July 1853 the above accuse [?] came on to be heard before Chancellor Ridley upon Bill and answer which it appears to the court that Elias Jones departed this life intestate & that complainant James Draper is his administrator legally appointed that previous his death he executed a deed to defendant James Jones for one hundred & fifty acres of land the same mentioned in Complainant's Bill that said deed though absolute on its face was intered as a Mortgage that the purposes of said mortgage have been answered & that said James has never paid anything for said lands That the defendant Parthena is the widow of deceased & had had [sic] her dower in other lands. that all other defendants except Laborn Loftis & children of deceased and his only lawful heirs that said Laborn Loftis intermarried with defendant Mary a daughter of the deceased & it further appeared that the legal debts of deceased exceeded his personal assets about $100. It is therefore ordered & decreed by the court that the deed to said land made by decd to the defendant James Jones be delivered up to be canceled & for nothing held & that the Clerk & Master after giving 40 days written notice of the time & place of sale at the courthouse door in Gainsboro at John Cummings Mill & at Alexander Montgomery's Mill till the land mentioned in Complainants [sic] Bill in a credit of 12 months taking not with good security from the purcher & also retain a lien upon said land until the payment of the purchase money & report to the next term of this court all other matters being resolved.
