Upchurch whom I am well aqauinted a man of good moral character and made oath in due form of Law that he is well acquainted with and knows the applicant John Keith that belonged to the same Co. and Regt. With him and that he knows it to be a fact that the said John Keith was badly wounded at the Battle of Fishing Creek KY in 1862 being shot in the left leg and thought the Right Thigh and that he was sent home on an wagon and that from the effects of said wounds he was never able to make a soldier or do military duty until after the close of the war and that he did not desert from the army of the Confederate States but was shot in Regular batle as above stated. Masis, Dear Sir, I thought I would write you in regard to John Keith. Pertition for his pensition if gove want anny more prof he wants to know it he is a mighty feeble old man and has belongs to Bive wack for 12 or 18 years he is men heare that says he was brought home woonded in a cart knowed him a I do. I thought it was my duty to write you these things and get you take his call in consideration and if you can do anny thing for him he needs it. His folks is all poor folks and is not able to do anny thing for him. Hoping you will think of him. I will close. Yours truly, N.A. Roherts Gainesboro, Tenn. April 2, 1909 Hon. John P. Hickman, I send you some additional proof in the Cases of W.W. Brown and John Keith. I don't see how they could have or printed, him that is Mr. John Keith, as a deserter. He shows by the very best evidence that he was severly wounded at Fishing Creek and was hawled home in an ox wagon. It must evidently be a mistake. He belongs to Stanton Brvonae No. 24 and if he was a deserter he never would have been admitted. His case was through leg ox armied at the time. Mr. Callie Collier his witness is a member of this Brovirae also. Pleas let this matter be called of at the next meeting of the Board. These men are both above 80 years of age. Guild, President Requerts records of above name Address: "The Military Secretary, War Department, Washington, D.C." 1158786 WAR DEPARTMENT THE MILITARY SECRETARY'S OFFICE, WASHINGTON, August 27, 1906. Respectfully returned to the President, Tennessee Board of Pension Examiners, Nashville. The Confederate records show that John B. (also borne as J.B.) Keath, but not as John B. Keith, was a private of Company G, 25th Tennessee Infantry, C.S.A. On the company muster roll for July and August, 1863 (last roll on which his name is borne) he is reported deserted July 15, 1863, near Chattanooga, Tennessee. The Union records show that one John _ Keith, private, Company --- 25th Tennessee Infantry C.S.A., a deserter, subscribes to an oath of allegiance at Nashville, Tennessee February 15, 1864. He is further described on the records as follows: Complexion, fair; hair, brown; eyes, hazel; height 6 feet; residence Jackson County, Tennessee. (Can not make out signature) The Military Secretary (M.S.O. 72-1) 838 Bloomington Springs, Tenn. May 7, 11 Mr. Jno P. Heickman Nashville, Tenn. Dear Sir, I beg to call your attention to application of John B. Keith of this place, who is now to the mercies of the people and says he is justly entitle to aid from the State. You will please answer me at once. Stating his record as a soldier and of the Disposion of his application. I have been informally thor the Legislation has passed a Law Prooiding for all Confederate Soldiers to Draw a Pension from the State also, that Widows, who were Married before 1890 are entitle, You will please inform me whether or not this he true and Greatly abliege you. Keith Who is an applicant for Pension under the Tennessee Pension law, claims to have been a member of Company G. Twenty fifth Regiment Tenn. Infantry C.S.A., and to have been wounded and disabled in battle of Fishing creek (or Mill Springs) KY in January 1862. (Continuation of C.H. Upchurch's Affidavit for John B. Keith) condition and has been for years from said wound that he is not able to make his support by manual labor and he has no incum from any source he was a good soldier and brave. His leg is now in bad condition and that he is dependant upon his children and friends for support affiant further states that he is not directly or indirectly interested in the prosecution of said claim. Upchurch State of Tennessee County of Jackson Sworn to and subscribed before me this day by the above named affiant, and I certify that I read said affidavit to said affiant with its contents before he executed the same I further certify that I am in no wise interested in said case nor concerned in its prosecution and that said affiant is personally known to me and that he is a credible person this August the 29, 1902.
