This file was contributed for use in the Tennessee USGenWeb Archives by: John Chase wall3555@bellsouth.net ============================================================================ JEFFERSON CO, TN CHANCERY COURT RECORDS June 1844-Dec 1846, p 1--- ABNER DOBBINS vs JACOB P CHASE and BIRD PATE Chancellor sitting for counties of Jefferson and Cocke at Dandridge June 1844 Orator: ABNER DOBBINS; Some years ago a contract was entered into between OBED CHASE PATE (sic) of Jefferson Co, since dec'd, in and by which contract the said DOBBINS for consideration that OBED CHASE had advanced to and for the said DOBBINS the sum of 4100.00 to secure the payment of which to said OBED your orator executed to him a bill of sale for a Negro man slave of great value, to wit of value of $1000.00 at least, named Sam of yellow complexion about 40 years of age ... that said bill was absolute upon its face, but was made expressly with a view to secure the payment of said sum of $200, that after the execution of said bill of sale the Negro by the consent of said ABNER DOBBINS was placed in the hands of said OBEDIAH CHASE to work out said sum of money at $109 per year, ... that under said agreement said boy remained with said OBED CHASE for term of 3 years and six months, a period more than sufficient to meet any demand the said CHASE had against your orator. ... the whole subject was talked over understandingly with the said CHASE and shortly before his death he acknowledged that he was fully paid all that was due him and that the same was satisfied by the labor of said boy and that the boy was your orator's property. At the time of the contract for the boy OBED CHASE executed his note to your orator for $200, this note was given back to said CHASE and not one cent was ever rec'd on it ... The note was given up to and for ought your orator knows remained with said OBED CHASE up to the time of his death. The said CHASE and your orator were related to each other ... trust and confidence in each ... no disposition to betray said CHASE ... CHASE had he lived would not have betrayed his part. Said OBED CHASE departed ... about March last (1840) intestate. JACOB P CHASE administered on the estate of said OBED after the Negro was given up to your orator and your orator never thought that he would be disturbed in the possession. Your orator hired the Negro to a certain LEE DYER of Grainger County who had him publicly in possession. But so it is about 8 days ago JACOB P CHASE and BIRD PATE with others most riotously came to the house of LEE DYER where the boy was and with force and arms, too, took said Negro from said DYER and run him from Grainger County into County of Jefferson, and one or the other of them have said boy in possession, holding him under the pretended claim by the bill of sale mentioned.... orator shows that from the best information he can get, the said J P CHASE and BIRD PATE are in doubtful circumstances and that the estate of said OBED CHASE is insolvent, so that if said Negro should be run, or in some way involved that your orator may be defrauded of him. But now so it is said CHASE and PATE both of Jefferson County ... orator prays each of them be made defdts hereto ... orator prays that an injunction be issued to prevent the removal of said Negro .... that the hire of said Negro be taken into account as a credit for any sum advanced to your orator ... 16 Nov 1840 .... ABNER DOBBINS made oath that foregoing bill of complaint ... true. (Order followed for injunction and order directing sheriff to take possession of slave Sam ...)
