Lea Ballenger & Juliann Ballenger to Sam N. Fain Registered March 17th 1854. This Indenture made and entered into this 16th day of March in the year of our Lord One thousand Eight hundred and fifty four by and between Lea Ballenger and his wife Juliann Ballenger formerly Juliann Brazelton of the County of Jefferson and State of Tennessee of the one part and Saml. N. Fain of the County and State aforesaid of the other part Witnesseth that the said Lea Ballenger and his wife Julian Ballenger for and in Consideration of the sum of___________to them in hand paid the receipt whereof is hereby acknowledged have and by these presents do grant bargain sell convey and confirm unto the said Saml. N. Fain his heirs and assigns forever all their undivided right title Interest Claim and demand in remainder that they have in and to a certain tract or parcel of land embracing all the lands of which the said Lea Ballenger and his wife Julian Ballenger have title to in any manner and which said lands are now in the possession of L. A. Brazelton lying and being in the County of Jefferson and State of Tennessee on Mossy Creek lying immediately between the lands of Patton Howell and H.H. Peck bounded on the North and West by the lands of H. H. Peck and bounded on the South by the lands of Patton Howell and by the lands of these on the East said lands were devised or willed by Dudly Cox to his daughter Polly Cox who afterwards intermarried with Lanty A. Brazelton and the said Julian Ballenger derived title to said land from her Mother the said Polly Brazelton. With all and singular the Woods Waters Watercourses ways hereditaments and appurtenances to their undivided interest in the said lands above described belonging or in any wise appertaining to have and to hold the same to the said Saml. N. Fain his heirs and assigns forever. The said Lea Ballenger and his wife Julian Ballenger formerly Julian Brazelton for themselves and their heirs do covenant and agree to and with the said Saml. N. Fain that they will warrant and forever defend the title to their undivided interest in the said Tract of land with its appurtenances to the said Saml. N. Fain his heirs and assigns forever against the lawful claim of all and every person or persons whatever, both in law and Equity In Testimony whereof the said Lea Ballenger and Julian Ballenger have hereunto set their hands and affixed their seals the day and year first above Written. And Julian Ballenger the feme covert having also personally appeared before me privately and apart from her husband the said Lea Ballenger and acknowledged that she Executed the Within Deed freely Voluntarily and understandingly without compulsion or restraint on the part of her said husband and for the purpose therein Expressed.
