L. A. Brazelton & others To W. D. & Saml. N. Fain Registered October 11th 1854. For Value received We the Signers of this instrument do hereby grant Sell and Convey unto W. D. Fain & Sam N. Fain and to their heirs and assigns forever all the water privaledge(sic) and fall of Mossy Creek on What is known as the Lanty A. Brazelton farm below the Lowell Factory on Mossy Creek Jefferson County Tennessee between the Lowell Factory farm and the farm of H. H. Peck, with the priviledge(sic) of entering upon and cutting down said fall so as to use the same by cutting out the tail race & creek that the said water fall may be used in connection with the fall on said Lowell Factory farm We will forever Warrant and defend the title to the same unto the said Wm. D. Fain and Sam N. Fain and their heirs and assigns forever against the title and claim of either or all of the undersigned or their heirs or assigns or of any other person or persons, either in Law or equity. Brazelton, the within named Bargainor, with whom I am personally acquainted, and acknowledged that they Executed the within Instrument for the purposes Therein Contained. And Amanda M. Balinger, and Sarah Hayworth the feme Coverts having also personally appeared before me privately and apart from their Husbands the said Jackson Balinger and Richard Hayworth, and acknowledged that they Executed the within Instrument freely Voluntarily and understandingly without compulsion on the part of their said Husbands and for the purposes therein Contained.
