William Ballenger Deed Trust to Aaron Ballenger Trustee For use and benefit of William Smith and Thomas Smith Registered October the 21st 1858. Know all men by these presents that Whereas William Ballenger of the County of Jefferson is indebted to one Wm. Smith in the County of Grainger in the sum of One hundred Dollars for which the said Ballenger has this day executed to said Smith his note of hand for said amount due and payable one day after date. And the said Ballenger is also indebted to one Thomas Smith of Grainger County in the sum of Fifty three dollars for which said Thomas Smith holds his note of hand dated 3rd February 1857 and due one day after date and the said Ballenger being desirous to secure the payment of the above named Notes with interest and in order so to do the said Ballenger hath and by these presents doth hereby grant bargain sell and convey unto Aaron Ballenger of the County of Jefferson a certain piece or parcel of land that the said Wm. Ballenger purchased of Wm. Brazelton as per Deed of this date will show Containing about thirty five acres more or less which the said Aaron Ballenger is to have and to hold on the terms and conditions as follows. Now should the said Wm. Ballenger within Twelve months from this date pay and discharge the above named notes with their interest, then and in that case this Deed of Trust to be null and Void But should said Ballenger fail to pay and discharge said notes with interest within Twelve months from this date then and in that case the said Aron Balenger shall upon being notified so to do by either of the above named parties, advertise said land for sale, for the space of 20 days at some of the public places in Jefferson County and then on the premises sell the same to the highest bidder for cash in hand and the proceeds in the first place be applied to the payment of the above debts and shall if any pay to said Ballenger the residual and the said Wm. Ballenger hereby authorizes and empowers the said Aaron Ballenger to make the purchaser a good warrantee title to said land He the said Wm. Ballenger hereby vesting in said Aaron Ballenger his heirs or assigns forever for the foregoing purposes In Witness whereof the said Wm. Brazelton the subscribing Witnesses to the within Deed after being first duly sworn depose and say that they are acquainted with William Ballenger the Bargainor that they saw him sign seal and acknowledge the same to be his act.
