Deed. Alexander Ballenger & wife to T. A. Elmore Registered October 27, 1893. This indenture made and entered into this 12th day of January 1889 between Alexander Ballenger and his wife Bell Ballenger of the one part and T. A. Elmore of the other part both parties of the County of Jefferson State of Tenn. Witnesseth that for and in consideration of the sum of One hundred dollars to the said Alexander Ballenger & his wife in hand paid by the said T. A. Elmore the receipt whereof is hereby Acknowledged. The said Alexander Ballinger and his wife Bell Ballenger has this day bargained & sold and doth hereby transfer and convey unto the said T. A. Elmore his heirs and assigns a Certain piece or parcel of land and it being all the undivided interest Mahala Fielden One of the heirs of James Fielden dec’d had in and to the following described tract of land and for a more particular description of said land & premises reference is here made to a deed Mahala Fielden made to Jackson Ballenger which said deed is registered in the Registers office Jefferson County Tenn. Dec 16th 1850 in Book No. 2 page 509 said tract of land situate & lying in 7th civil District Jefferson Co. Tenn. Supposed to contain three hundred acres more or less and it being the tract of land upon which the late James Fielden dec’d lived upon & owned in his lifetime and bounded as follows. On the North by Alfred Northern lands On the South by T. A. Elmore & others on the west by James Northerns heirs and on the East by Northerns & Elmores with all and singular the woods waters & appurtenances thereunto belonging to the said undivided interest of the said Mahala Fielden in said tract of land to have and to hold said undivided interest of Mahala Fielden in said tract of land to the said T. A. Elmore his heirs and assigns forever. And the said Alexander Ballenger & his wife Bell Ballenger doth further covenant with the said T. A. Elmore that they are lawfully seized & possessed of said land and that they have a good right to convey the same and that the same is unencumbered. And the said Alexander Ballenger and his wife doth further bind themselves their heirs and assigns that they will forever warrant & defend the title to the said undivided interest in said tract of land to the said Thomas A. Elmore his heirs & assigns against the lawful claim or claims of all persons whomsoever. Witness Our Signatures day & date first written. Witness Alexander (his X mark) Ballenger Wm. Provence Notary Public in and for said County the within named bargainors Alexander Ballinger & wife Bell Ballenger with whom I am personally acquainted and who acknowledged that they executed the within instrument for the purposes therein contained. And Bell Ballenger wife of the Alexander Ballenger having appeared before me privately and apart from her husband the said Bell Ballenger acknowledged the execution of the said Deed to have been done by her freely voluntarily and understandingly without compulsion or constraint from her said husband and for the purposes therein expressed.
